Resolution 058760E3OLUTT0i C. 5876 ORDEPI00 THE VACATION OF PTBLIC UTILITY PASE:YEYliS IN BLOCK 6, TRACT 1866, SOUTH SHOPE UNIT. NO. 1, IN THE CITY OF ALAYEDA. WHEREAS, the Council of the CIA-,y of Alameda did, on the 18th day of Ncvem- bon, 1958, pass its Resolution of Intention No. 5864, declaring it intention to order the vacation of certain public utility easements in Block 6, Tract 1866, South Shore Unit No. 1, in the City of Alameda, shown on Map recorded October 30, 1957 in Map Book 38, pages 50 to 59, inclusive, in tho Office of the County Recorder of Ala- meda, State of California, described as follpws: Five-foot public utility easements extending 55' westerly from the most westerly line of Lot 11, Block 6, in the above described nap and lying along the sidelines between Lots 1 and 2, 3 and 1, 5 and 6, 7 and 5, and 9 and 10. Ten-foot public utility easements lying on both sides of Inc most westerly line cf Lot 11 extending 530' from a point 3' northerly of the most southerly line of oleo 6 to e point 3' southerly of Inc most northerly line of said Elock 6. and WHEREAS, the City Clerk: cf the City of Alameda caused said hesolution of Intention to be published in the manner prescribed by law for the publishing of ordi- nances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation published ant circulated in said. city and the official newspaper thhreof; and WHEREAS, proof of said publication is evidenced by an affidavit of publica- tion now or file in the office of the City Clerk of said city; and WHEREAS, proof of said posting of such notices is evidenced by the affidavit of the person posting said notices, which. affidavit sets forth the facts regarding such. posting and to now on file in the office of the City Clerk of said city; and WHEREAS, the matter of said proposed . vacatinn came on regularly for hearin before the Council of the City of Alameda at this, Its regular meeting, on the 16th day of December, 1958, and at the time and place fixed in said Resolution of Intention, and at such hearing the said Council heard the evidence offered by all persons inter- ested to said vacation of easements, and a full hearing thereon having been had and the matter submitted for determination; NOW THEREFORE, BE IT RESOLVED BY TEE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence subpdtted, that the easements in said Resolution of Intention and hereinbefore more particularly described, • are unnecessary for present and prospective public utility purposes and that the pub- lic interest requires the vacation of said easements.
