Resolution 05877RESOLUTION NO, 5377 ORDERING. THE VACATION OF A PORTION' OF Of 'O' 5TliEET, IN TEE CITY OF ALANEDA. YHERFAS, the Council of the City of Alameda did, on the 18th day of Novem- ber, 1958, pass its Resolution of Intention No 5863, declaring its intention to order the vacation, closing and abandonment of that certain cortion of Morton Street, in Inc City of Alameda, County of Alameda, State of California, more particularly described in said Resolution of Intention as follows: ALL that nortion cf Morton Street north of Pacific Avenue, as shown on Drawing 4766, Case 54, a cony of which 13 on file in the City Clerk's Office, Alameda, California. and WEEREAS, the portion of said Morton Street to be vacated and abandoned and the details of said vacation are more particularly shown upon that certain map known ss Drawing 4766, Case 54, City of Alameda Engineering Department, entitled, "Aorton Street to be Abandoned North of Pacific Avenue", which map was by said resolution of Intention approved for the purpose of this proceeding and was ordered filed in the office of the City Clerk of the City of Alameda and marked "Flied Nov. 18, 1958", and which map wa2 in said resolution referred to for further particulars as to the proposed vacation; and WHEREAS, the City Clerk of the City of Alameda caused said Resolution of L ntention to be published in the manner prescribed by law for the publishing of ordi- nances of the it of Alameda, in the Alameda Times-Star, a daily newspaper of general. circulation published and circulated in said city and the official newspaper thereof; and WHEREAS, proof of said publication is evidenced by an aTfidavit of publica- tion now on file in the office of the City Clerk of said city; and WHEREAS, proof of mid posting of such notices is evidenced by the affidavit o' the parson posting said notices, which affidavit sets forth the facts regarding such posting and. is now cr file in the office of the City Clerk of said City; and WhiEREAS, the matter or said proposed vocation C6,730 on regularly .or hearing before the Council of the City of Alameda at this, its razular meeting, on the 16th day of December, 1956, and pt the time and place fixed in said Resolution of Intention, and at such hearing the said Council heard the evidence offered by all persons inter- ested in said street vacation, and e full hearing IF ex havinF been had and the matter submitted for determination; NOW TEEREFORE, BE IT RESOLVED EY THE COUNCIL OE THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that the street and part thereof in said Resolution of intention and hereinbefore more part larly described, is unnecessary for present and prospective public street purposes and that public interest requires the vacation of said portion of said street.
