Resolution 05880) RBSOLUBION NO, SBOC AUTHORIZING COMPROMISE OF' DISPUTED CLAIM. HEPEAS, there is a dispute presently existing between the City of Alameda and the Pacific Bridge Company concerning rights, 'duties, obligations and liabili- ties of the respective parties to repair and reconstruct that certain sewer eleseribed in that certain Easement dated September 27th., 1956, in which. Pacific Rridge Company is the Crantor and the City of Alameda is tne Grantee; and. WHEREAS, the City of Alameda may have an obligation to replace Inc present wooden StE)VO sewer at some future date; and WHEREAS, Pacific Bridge Company has offered to replace said wooden sewer with approximately 289 lineal feet of 33° I.D. x 12, rubber gasketed concrete pipe, standard strength, as manufactured by the American Concrete Pipe and Construction Co., Por the sum of Nine Thousand ( 0) Dollars; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OP ALAMEDA that, in consideration of the settlement of the disputed claim now existing between the City of Aiamedm and Pacific Bridge Company, the City of Alameda. does h.ereby authorize and instruct the Auditor to deliver to Pacific Bridge Company the sum of NINE THOUSAND 09,ono.00) DOLLARS upon the completion of the work of reconstructing the storm sewer at the nbrtheast corner of the former Encinal Housing Project property, said work to consist of furnishing of all labor, materials and equipment to perform the following: 1. Remove existing sewer between stations 0400 and. 2489 approximate. 2. Cut off or break or existing plii.g where they will interfere with new construction. 3. Excavate for new pipe. 4. FurnIsh and place a one-foot thick blanket of 1" to Me crushed rock as bed. for pipe. 5. Furnish and place approximately 289 lineal feet of 33 I. D. x 12, rubber gasketed concrete pipe, standard strength, as manufactored by the) American Concrete Pipe and 10032103 133 Co. 6. Backfill in trench around pipe to a mmade one foot above top of pipe with sand. Backfill. balance of trench with existing material, 7. Rip rap the slopes of the existing bank at the discharge end for a distance of appxmEEimately 10 feet on either side of the center of pipe. 8.
