Resolution 059104 7 3 RESOLUTION NO, 5910 DECIldnr1 CANVASS OP' RETURI,M. AND RESULT OF GENERAL MUNICIPAL ELECTION, HELD ON Ms 10, 1959. NEMEAS, a general Municipal Election was hold in the City of Alameda cn Tuesday, March 10, 1959, under and. pursuant to the provisions of Article XIX of the Charter of said City, for the purpose of electing officers to fill the office of Councilman - and. for the further purpose of submitting to the qualified electors of said City the questions of amendinn the Charter of the City of Alnmeda, as set forth hereinafter: Two (2) Councilmen on the Council. of said City for two .(2) full terms, each term commencing at 7:30 o,cloek p.m. on the thArd TuesdaT in 2) L, 1)59, and continbIng for fouh (E) years thereafter, and until successor is elected. and qualified. MEASURE A Shall the Charter of the City of Alameda be anended to provide that the offices of City Aubitor, ex-officio Assessor; and City Trersurer, ex-officio Tax Collector, be appointive by the City Manager rather than elective; hrovidd, that tho incumbents of such offices shall be retained until the end of their present term of office; pro- vided, further, thbt such offices may be consolidated by the City Manager thereafter? Said amendment also provides for the repeal of Articles IV and V of Charter ‚28 'l'( to the duties of the above respective officers and requires the Council, by ordinance or resolution, to set out the cubes to be attached to the respective offices. Said amendment will be accom- plished by amending Sec. 2-1 and Sec. 2-3 of Article II, by adding Sec. 3-20 to Article III, and by adding See. 7-13 to Article VII, of' said. Charter, all as fully set forth in Resolution. Nb. 5890 of Councia of the City of Alameda. MEASUEE B Shall 'the Cnarter of the City of Alameda be amended authorizing the Council to transfer to the County of Aaameda, by contract or other arrangement, any or all of tho tax assessing and tax. collecting func- tions and services of the City? Such of the Cityns functions and services as are transferred would be suspended while being fow111shed by the County, but 101 City retains the right to reassume any Or all of the transferred functions and services. Said anbndment will be accomplished by adding Sec. 3-21 to Article III of said. Charter, all as fully set forth in Resolution No. 5891 of the Counbil of the City of Alameda. maA SURE C Shall the Charter of the (31,' of Alameda be amended to provide that the Council shall adopt a budget and tax. rate at anT time prior to the third Tuesday of September of each year, rather than after the first day of September and not later than the third Tuesday in September of each. year, by amending Sec. 1 of Article XVII of said. Charter, all as fully set forth in Resolution No, 5852 of the Council of the City. of Aaameda. 1.41=ESEAS, nominating petitions were duly and regularly presented to, and filed in (3 1' office of, the City Clerk of the City of Alameda, in the time, form and manner prescribed by the Charter of said City, nominating for said. offices the follow- ing persons, to wit: FOR Tho 02ICE COWNCILMAN: Franz S. "(3 0<3(3 WHEREAS, said nominations were entered. in a list, with the offices to be filled, which list was certified to and filed in the time, form anb manner required said Charter, whereupon an Election Proclamation, signed by the Mayor of the City of Alameda, and attested. by the City elerk, and containing a statement of the time of the election, the offices to be filled, the names of the candldates and the measures to be voted on, as the same dere, by. the Council of the City of Albmeda, ordered to be printed and appear oc the ballot, was duly and regularly issued more than ten (10) days before said election and was published twice in the official news- paper of said City., the last publication thereof being more than five (5) days before the date of said election; and WHEREAS, there were 117 election precincts within the City of Alameda fixed and established by resclbtion of the Council of said City and designated as the 11-1 4 e)action precincts for holding the aforesaid General Municipal Election of to' City of Alameda; and WHEREAS, all of the ballots used for said elmction were prepared, as to form and contents, as prescribed by law, and a sample ballot was mailed to each voter of the City of Alameda within the time and in the mmnner provided by law and such. mailing was cmmpleted at least ten (10) days preceding the date of said election; and WHEREAS, the officers of election for said election were duly appointed and qualified, and all election supplies furnished and election booths provided for-ea:Ha precinct as provided by law; and WHEREAS, the Council of the City of Alameda at this, its next regular meet- i)ng following said election, has met and fully canvassed the returns of the votes cast at said General. Municipal Election as required by law, and being fully advised in the premises, and hamming the returns of said canvass before it; NOW, THEREFORE, BE IT HEREBY RESOLVED, DETERMINED AND DECLARED BY THE COUNCIL OF THE CITY OF ALAMEDA and said Council finds, as folloms: (1.)
