Resolution 05917RESOLGTITT NO. 5917 RESOLUTION OF THE COUKUIL OR' THE CITY OS' ALAMEDA RELATING 1 0 0 KIIGATICKS "10 BE ASSUMED IN CONNECTION WITH TEE PROJECT OF INCREASING 5 ESTUARY CHANNEL DEPTH TO TEIRTY-FIVE FEET (OAKLAND HARBOR—SAN FRANCISCO HAY TO PARK STREET BRIDGE). WHEREAS, the United States army, Corns of Enginaers, San Francisco Oisbriot, is prepared to submit to heabauartebs in Washington, D. C., its recommcndations in connection with a project for improvement of the Inner Uarbon of the OitLy of OakEand, consisting of increasint7 the channel depth 'rem thirty (la) fer to thirty-rive (3E) feet -below mean lower low Pater; and WHEREAS, in connection with such recommendations it is requiredYthat local interests acting thrr ugh. a qualified public agency assume certain obligations and. make certain assurances in connection therewith; NOW, THEREFORE, BE IE RESOLVED BY THE COUNCIL OF TEE CITY OF ALAMEDA that in connection with said project the Council of ths City of Alameda does hereby agree as follows, provided, however, that suRh agreements '1 11 be effective only within the territorial limits of the City of Alameda: 1, That at the proper time a10 d. upon receipt of appropriate requpst therefor, it L-1.1 provide, without cost to the United States of America, such ease- ments and rights-ofpwey as eTx., necessary for the initial dredging and subsequent maintenance; 2. That it will. hold and save the United States of America fres and harmless from damages to wharves, piers, tubes and. otLer marine and submarinE struc- tures due to the initial d.redging work and subsequent maintenance dredging, provided, hpwever, that this indemnity shall not apply where any such damage is caused by any. dredging work, initial or maintenance, beloLl a depth of tharty-fgre OH) feet below mean lower low pater, and within fifty (50) feet of the traffic tubes between the cities of Oak:land anb Alameda; and. That it will accomplish, withut expense to the United.
