Resolution 059417 RESOLUTION NO, 5941 RESOLUTION OF INTENTION TO ORDER THE VACATION OF A PORTION OF EVERETT STREET, IN THE CITY OF ALAMEDA (NORTHERN END—EVERETT STREET) 05301 000 BY THE COUNCIL OF THE CITY OF ALAMEDA that the public interest requires, and said Council hereby declares its intention to order the vasatinn, clos- ing and abandonment of that certain portion of Everett Street, in the City of Alameda, County of Alameda, State cf California, and more particularly described as follows: BRING a parcel of land, 60 feet wide, further described as follows: BECINNING on the southeasterly line of Everett Street, 60 feet wide, distant thereon North 34* 23' OE" East 116.00 feet (ahsumed for the purposes of this description and based en the California System of Coordinates, ?one III, as are all bearings and distances in this description) from the northeasterly line of Blsnding Avenue, 60 feet wide, as said street and avenue are shown on the "Man of the Jenks and Mead Homestead Tract" filed June 23, 1869 in Bock 6 of Maps, at page 12, in the Alameda County Record.- er's office; THENCE North 55* 36, 30" West 60.00 feet to a point on the northwesterly line of Everett Street, distant thereon North 34* 23, 08" Ea3t 116.00 feet from the northeasterly line of Blanding Avenue, 60 feet wide, as said street and avenue are shown on the "Man Alameda Station Homestead Tract" filed March Di, 1868 in Book 17 of Maps, at page 60, in the Alameda County Recorder's office; THENCE Ncrtn. 34* 23' 08" East along said northwesterly line of Everett Street, 184.50 feet to the southerly line of that parcel of land described in that suit in condemnation entitled "The United States, Plaintiff, vs. M. Crooks, et al, Defendants", a copy of which was recorded October 20, 1894 in Rock 276 of Deeds, at page 59, in the Alameda County Recorder's office; THENCE South 60* 13' 14" East along said southerly line, 60.19 feet to the aforesaid southeasterly line of Everett Street; THENCE South 34* 23' 08" West along said southeasterly line of Everett Street, 189.34 feet to the BEGINNING'. RESOLVED, FURTHER, that said Council finds and determines that the public convenience and necessity require the reservation to the City of Alameda of a. permanent easement and right-of-way over and across and under a certain parcel of land situate In that portion of Everett Street proposed to be vacated, for the purpose of constructing, operating, maintaining, replacing, renewing and repairing a. joint pole for public utilities with necessary guy wire attachments, and said permanent easement and right- of-way for the aforesaid purposes is hereby reserved to the City of Alameda and excepted from the vacation of said portion of Everett Street, over, across and under that certain parcel of land situate in the City of Alameda, County of Alameda, State of California, and more particularly described as follows: BEIM', a parcel of land, 12.00 feet wide, and further described es follows: COMMENCING on the southeasterly line of Everett Street, 60 feet wide, distant thereon North 34* 23' 08" West 116.00 feet (assumed for the purposes of this description and based on the Califcrnia System of Coordinates, Zone as are all bearings and distances in this description) from tha northeasterly line of Blanding Avenue, be feet wide, as said street and avenue are shown on the "Map of Jenks and Need Homestead Tract" filed Juno 23, 1869 in Book 6 of Maps, et page 12, in the Alameda County Recorder's office; THENCE North 55* 36, 30" West 4.00 feet to the TRUE POINT OF BEGINNING; THENCE North 55* 36' 30" West 12.00 feet; THENCE North 34* ?-_31 08" East, parallel with. the aforesaid southeasterly line of Everett Street, 10.00 feet; THENCE South 55* 36, 30" East 12.00 feet; THENCE South 39 23' 08" Kest 10,00 feet to the TRUE POINT OF BEGINNING. RESOLVED, FURTHER, that said Council finds and determines that the public convenience and necessity require the reservation to the City of Alameda of a permanent easement and right-of-way ever and across and under a certain parcel of land situate in that potion of Everett Street proposed to be vacated, for the purpose of ccnstruct- ing, operating, maintaining, replacing, renewing and repairing storm and sanitary sewers, and said permanent easement and right-of-way for the aforesaid purposes is hereby reserved to the City of Alameda and excepted from the vacation of said portion of Everett Street, over, across and under that certain parcel of land situate in the City of Alameda, County of Alameda, State of California, and more partionlarly described . as follows: BEING a strip of land, 10.00 feet wide, and further described as follpws: BEGINNING at a point on the northwesterly line of Everett Street, 60 feet wide, distant alcng said line North 34* 23 08" at 116.00 feet (assumed for the purposes of this description and based on the California System of Coordinates, Zone III, as are all bearings and distances in this des- cription) from the northeasterly line of Blanding Avenue, 60 feet wide, aa said street and avenue are shown on the "Map Alameda Station Homestead Tract" filed March 18, 1868 in Book 17 of Maps, at page 60, in the Alameda County Recorders ofrice; THENCE North 34* 23' 08" East along said northwesterly line of Everett Street 184.30 feet to the southerly line of that parcel of land described in that suit in condemnation entitled "The United States, Plaintiff, vs. M. Crooks, et al, Defendants", a copy of which was recorded Octnber 20, 1884 in Book 278 of Deeds, at page 59, in the Alameda County Recorder's office; THENCE South 60* 13' 14" East along said southerly line 10.03 feet; THENCE South 34* 23' chd" West, parallel to said northwesterly line of Everett Street and 10.00 feet at right angles therefrom, a distance cf 185.31 fne THENCE North 55* 36, 30" West 10.00 feet to the BEGINNING. RESOLVED, FURTHER, that the portion of Everett Street to be vacated and abandoned and the details of said vacation ere more particularly shown upon that cer- tain map known as Drawing 4800, Case 24, bearing the legend: "Clositv of Everett Street North of Blanding Avenue--Utility Easements and Sewers Alterations", which. map is hereby approved for the purpose of this proceeding and is hereby ordered flied in the office of the City Clerk of the City of Alameda, and which map is hereby referred to for particulars es to the proposed vacation. RESOLVED, FURTHER, that the 16th day of JUNE, 1959, at 7:30 o'clock p.m. of said day, in the COUNCIL CHAY3ERS in the CITY HALL, at the northwest corner of Santa Clara Avenue and Oak Street, Alameda, California, be, and the same is hereby, fixed as the time and place for hearing by the Council of said City of all persons interested in or objecting to the proposed vacation. RESOLVED, FURTHER, that the City Clerk of the City of Alameda is hereby directed to cause this resolution to be published, in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, e daily newspaper of general circulation published and circulated in said City, and the official newspaper thereof. RESOLVED, FURTHER, that the City Clerk of the City of Alameda is hereby directed to post, or cause to be posted, conspicuously along the line of the street and parts of street proposed to be vacated, notices of such vacation, in the form and manner required by the legislative act hereinafter mentioned, RESOLVED, FURTHER, that in the herein proposed vacation of said street or portion of street aforementioned, the Council cf the City of Alameda hereby elects to proceed under and in pursuance of the provisions of the Street Vacation Act of 1951 of the State of Celifornts (Chapter 250, Statutes of 1941), as emended. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regu- lar meeting assembled en the ]9th day of May, 1959, by the renewing vcte, to wit: AYES: Councilmen Collischene, Freeman, Petersen, Schacht and President McCall, (5).
