SETTING THE EFEECTIVE DATE OF ORDER OF THE COUNCIL
OF THE
CI' OF ALAMEDA VACATING A FORIdUN OF EVERETT
STREET, IN THE (IFFY OF ALAMEDA, AS SEAT FORTH IN
RESOLUTION NO. 5949 OF THE COUNCIL OF TEE CITY OF
ALAMEDA.
WHEREAS, by Resolution No. 5949, the Council. of the City of Alamedn mill
order the vacation of a portion of Everett Street, in the City of Alamda, and
WHEREAS, it is the intent of (lo Council of the City of Alameda. ;Mint such
order be effective and in force only' at•such time as certain street and public
improvements be installed. ir nn area abutting and. adjacent to the portibn '1 Everett
Street to be vacated;
NOW. THEREFORE, BE IT RESOLVED BY TEE COUNCIL OF' THE CITY OF ALAMEDA that
Resolution No. 5949 ordering the vacation of s portion of Everett Street, in to
City. of Alameda, sha 0 C in effect or of any "force whateoevbr until au.c0 time
as the City Engineer of the City of Alameda files with the City Clerk of the City of
Alameda a certification stating that street and 01b 'e improvements abutting and
uldjacent to the portion of Everett Street to be abandoned have been installed in sub-
stantial conformance with. that certain map known as Graming 4800. ..Case 24, bearing
the legend, "Closing of Everett Street North. of 11 100100 Avenue—Utility Easements
and Sewers Alterations", being Sheet 1 of 1, dated March 1959, three copies of which
are on file in the office of the City Clerk of the City of Alameda; the said street
and public improvements referred to herein are generally described. as the construe-4
tion of two Type 1. catch basims and local depr.essions and installation of 42 • F. +
of 12" R-C.C.P., and reconotruction of curt, pavement, necessary.
BE IT FURTHER REBCIVED that the City Clerk be, and is hereby directed. not
to record. said order vacating a portion of Everbtt Street until such. time as the
City EgAneer's certificate referred to above be filed with the said City Clerk,
BE IT FUEifHER RESOLVED tht.this resolution shall be deemed to qualify and
becono a part of Resolution No. 5949 until such time as the qualifications contained
herein become satisfI'd,
