AUTHORIZING THE MAKING OF AN ORDER APPROVING PETITION
FOR EXCLUSION OF LANDS FROM RECLAMATION DISTRICT NO.
2087.
WHEREAS, the petition of certain landowners in Reclamation District No. 2087,
acknowledged by each of the petitioners, for exclusion from said District of certain
lands owned by the petitioners and certain lands contiguous thereto owned by others,
was filed with the Council of the City of Alameda on November 2, 1959; and
WHEREAS, pursuant to Division 5, Part 10, Chapter 2, Article 2, of the
Water Code of the State of California, hearing on said petition was had before said
Council at a regular meeting thereof on November 17, 1959; and
WHEREAS, at said hearing, said Council heard said petition, all evidence
and proofs introduced by or on behalf of the petitioners, all written objections to
said. petition, and all evidence and proofs introduced in support of such. objections,
all of said evidence having been taken down in shcrthand and a record thereof ordered
made and filed. with said Council; and
WHEREAS, following said hearing the matter was submitted for decision by
said Council; and
WHEREAS, said Council has found and determined and does hereby find and
determine that;
1. The statements made in said petition are true and correct and are
sustained by said evidence and proofs introduced. by and on behalf of petitioners;
2. Said petition contains all statements required to be contained
therein and is properly acknowledged in the manner provided by law;
3. Notice of the filing of said petition was duly and regularly pub-
lished for at least two weeks in a newspaper of general circulation published in
the City of Alameda and a copy thereof was mailed by the Clerk of the City of Ala-
meda, postage prepaid, to the postoffice address of e ach person owning property
within said Reclamation District at least ten days before the day set for said
hearing;
4. Said notice contained all statements and matters required to be con-
tained therein;
5. It is for the best interests of said Reclamation District that the
lands mentioned in said petition be excluded from said District;
6. No objection to said petition has been established; and
7. Ali matters, acts and things necessary or precedent to the approval
of said petition or the making of the order hereafter referred to have been duly and
regularly done and performed in accordance with law;
NOW THEREFORE, BE IT RESOLVED BY THE 0002010 OF THE CITY CF ALAMEDA as
follows:
1. That the petition of certain landowners within Reclamation District
No. 2087 for exclusion of certain lands from said District be, and the same is hereby,
annroved,
2. That the President of the Council be, and he is hereby, authorized and
directed to make and sign, and the City. Clerk to attest, es the act and deed of the
Council of the City of Alameda, an Order approving said petition and excluding the
lands described therein from the boundaries of Reclamation District No. 2087, which
Order shall be in the form hereunto annexed, which form is hereby approved, marked
'Exhibit A", and by reference made a part hereof.

I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly introduced and adopted by the Council of the City of Alameda in regu-
lar meeting assembled on the 15th day of December , 1959, by the following
vote, to wit:
AYES: Councilmen Collischcnn, Schacht and President McCall, (3).
NOES: Councilman Freeman, (1).
ABSENT: Councilman Petersen, (1).
