Resolution 06066RESOLUTION NO. 6066 AUTHORIZING THE ACQUISITION OF CERTAIN REAL FROFERTY FOR PUBLIC STREET AND HIGHWAY FURPOSES TnTeLDEN WAY (HCSARIA CIRIMELLI). WHEREAS, public interest and necessity require that the real property here- inafter described be acquired by the City of Alameda for use by said City for public street and highway purposes; and WHEREAS, Rosaria Cirimelli (a widow) is the owner of the real property situ- ated in the City of Alameda, County of Alameda, State of California, hereinafter described, and is willing to sell the same to the City of Alameda for the sum of ?25.00; NOM THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE 0172 OF ALAMEDA that the City of Alameda purchase from Rosaria Cirimelli (a widow), for the sum of '.25.00, that certain real property situated in the City of Alameda, County of Alameda, State of California, more particularly described as follows: PORTION of the parcel of lend described es Parcel 12 in the decree of final distribution rendered May 11, 1953 in Superior' Court, Alameda County, in the Estate of Salvatore Cirimelli, alias, deceased.; certi- fied. copy whereof was recorded May 20, 1553 in Book 70311 of Official Records of Alameda County, page 17, (AH-45079), described as fellows: BEGINNING at the intersection of the southeastern line of Foley Street with the northern line of the right of way, 50 feet wide, formerly of the Sen Francisco and Alameda Railroad, now the Central Pacific Railway Company; running thence alcoa the last named line easterly 42.67 feet to the northeastern line of the parcel of land above referred to Re Parcel 12; thence along the last named line north 55* 1.9' 29" west 1.65 feet, to a point from which the center of a circle with e radius of 619.13 feet bears north 34' 09" west; thence along the are of said circle, westerly 41.53 feet to the point of beginning, The bearings end distances used in the above description are based on the California Coordinate System, Zone 3, on the following terms and eonditions: (a) That good and merchantable title in fee simple in said real property he conveyed to the City of Alameda, free and clear of all objections, liene and encumbrances. (b) That the title to said real property be evidenced by a policy of title insurance, issued by the California Pacific Title Insurance Company, insuring title in the City of Alameda, se provided in the preceding subdivision, said title insurance to be at the expense of the City. (o) That upon deposit with said title company, for delivery to the City of Alameda, of a good and sufficient deed of grant conveying said real property to the City of Alameda, end conditioned upon the issuance of e title ineurance policy, as aforesaid, to be approved by the City Attorney, a warrant of the City he drawn for $25.00, payable to the order of and delivered to said California Pacific Title Insur- ance Company, as escrow holder, for the purpose of effecting the consummation of said purchase. RESOLVED, FURTHER, that the sum of 925,00, together with a sum sufficient to cover coat cf title insurance and other incidental expenses to said transaction is hereby appropriated from the Speciel Gee Tax Street improvement Fund (Account 222) to pay the purchase price of said real property, cost of said title insurance policy, and incidental expenses. * * • * * -t-** * I, the undersigned, hereby certify that the foregoing Resolution WRS duly and regularly introduced and adopted by the Council of the City of Alameda in regu- lar meeting assembled on the 3rd day of May, 1960, by the following vote, to wit: AYES: Councilmen Colliechorn, Freeman, Petersen, Schacht and President McCall, (5).
