RESOLUTION OF THE COUNCIL OT' THE CITY OF ALAMEDA AUTHORIZING
INSTALLATION OF SPUR TRACKACE IN AND ACROSS GRAND STREET BY
ALAMEDA BELT LINE (BETWEEN C1" 1N AVENUE AND EAGLE AVENUE).
BE IT RESOLVED 2' THE COUNCIL OF THE CITY (11 '1 4'
SECTION 1. That a permit be, and is hereby, granted to the Alameda Pelt Line, a corporation,
to construct, reconstruct, maintain and operate railroad spur trackage in and across Grand Street, in
the City of aTiameda, County of Alameda, State of California, as shown in red on print of Division
Engineer's Drawing T-I8-399, revised July 11, 1960, the center lines of said spur trackage being more
particularly describeh aa ,,l 13083
COMMENCING at a point on the Easterly Line of Grand Street, 141.2 feet southerly
from the Southerly line of Clement Avenue; thence westerly along a curve to the right,
having a radius of 603.81 feet, 5.0 feet; thence westerly, along a tangent to said
curve, 27.33 feet; thence continuing westerly along a tangent curve to the right,
having a radius of 323.54 feet, 61.6 feet to a point on the Westerly line of Grand
Street, 190,6 feet southerly from the Southerly line of Clement Avenue, the described
track being shomp in red,

the location of said spur trackage being also delineated in red on that certain map entitled "Alameda
Belt Line—Proposed Track Connection Across Grand Street, at Alameda, Calif.", as 311. .1'. July 11,
1960 and being Drawing No. T-18-399, said map being attached to and forming a part of said Alameda
Belt Line's petition relating to this matter dated FeEruary 20, 1961, which is on file in the ofTice
of the City Clerk of the City of Alameda, which said map is hereby referred to and made a part hereof
as if fuliy set out herein.
SECTHCHi 2. This permit is granted on and subjeet to the following MPrais and conditions:
(a) That said spur trackage shall be used for the transportation of freight only and shall
not be used as a mein line or part thereof.
(b) That said spur trackage shall be constructed and maintained level with the street along
or across which said spur trackage is laid,
(c) le-' 1. shall magntain in good repair the street area, including sidewalks, curbs
and gutters, far a width of four and onedhalf (480 feet on each side of the center llne(s) of such
trackage.
(d) Permittee shall adjust the elevation of said spur trackage to any and every change made
in the street elevation, including sidewalks, curbs and gutters.
(e) Permittee shall make certain changes in the 1. 11111111. on the easterly side of Crand Street
and in the 2a," storm sewer under sidewalk on the westerly side of Grand-Street, and other certain sur-
face improvements as required by the City Engineer of the City of Alameda.
(f) That all switching movements over such spur trackage shall. he so conducted as nor to
block longer than is necessary for ordinary switching operations the streets which are crossed by such
spur trackage or to otherwise interfere with the nse of the streets by the public.
(g) That this permit shall be indeterminate and shall be revocable udthout compensation at
any time at the sole option of the Council of the City of Alameda.
(h) That said spur trackage shall be operated under such regulations and conditTons as may
be prescribed from Lime to time by the City Council of the City of Alameda.
(i) That notwitheianding anything to the contrary in this permit, 0<1111 3113' shall at all
times maintain said spur trackage in good repair.
(j) Permittee shall repave, repair and otherwise restore the portions of any street daamged
or disturbed by the installation of such spur Trackage, using the same kind. of material and construc-
tion as now exists in the portions of any such street, including sidewalks, curbs and gutters adjacent
to the portions of said street wherein said spur trackage snail be installed.
(k) That on revocation or termination of this. permit the Permittee shall, at its own cost
and expense, forthwith remove sard spur trackage and repave, macadamize or otherwise restore the por-
tions of the street, including sidewalks, curbs and guttexs, damaged or disturbed by such removal,
using the same kind of material and construction as shall be used by the City of Alameda upon the por-
tion of the street adjacent to said spur trackage.
(1) All works of construction, relocation, maintenance and repalr requbred herein shall be
accomplished at the sole cost and expense of Permittee and at City standards as set or required by
the City Engineer of the City of Alameda.
(a0 in the event that the Permittee shall neglect or refuse to repave, repair or otherwise
restore the portions of any street damaged or disturbed by the Installation of said spur trackage as
providod in paragraphs (c), (d), (e), (/) and (j) above, or in the event that Permittee shall neglect
or refuse to remove such spur trackage andlor to repave and restore said street after the removal. of
said trackage as bereintiefore provided in paragraph (k), then the City of Alameda may cause such repav-
ing, repair or restoration to be made or such track to be removed or the work of repairing, macadamiz-
ing and otherwise restoring said street, to be done, and Permittee shall thereupon be obligated to
pay to the City the amount of the reasonable expenses incurred by the City for any such purposes.
(n) Thls permit shall not be assigned unless the conaent of the Council of the City of
Alameda be first had and obtained. Any attempt to so assign or assignment thereof shall cause an
immediate revocation of said permit.
(oi The construction by the 1' (1 herein named of said spur trackage shall be deemed
an acceptance by the Permittee of all the terms and obligations set forth in this permit.

introduced and adopten hy the Council of the City of Alameda in regular. meeting assembled on the
Ith day of March, 1981, by the following vote, to wit:
