Resolution 06341CITY OF ALAMEDA RESOLUTION NO. 6341 RESOLUTION OF THE COUNCIL OF THE CITY OF ALAMEDA OF INTENTION TO ORDER THE VACATION OF A PORTION OF MARKET STREET, IN THE CITY OF ALAMEDA (SOUTH OF FILLMORE STREET). RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the public interest requires, and said Council hereby declares its intention to order the vacation, closing and abandonment of that certain portion of Market Street, south of Fillmore Street, in the City of Alameda, County of Alameda, State of California, described es follows: A parcel of land 60 feet wide, further described as follows: BEGINNING at the intersection of the southwestern line of Fillmore Street (formerly Webster Street) 60 feet wide, with the southeastern line of Market Street, 60 feet wide, as said lines and streets are shown on the "Map of Town of Alameda and Adjacent Lands" as surveyed by H. A. Higley and filed September 12, 1867, in Book 5 of Maps, at page 16, in the Alameda County Recorder's office; THENCE southwesterly along said southeastern line of Market Street 100 feet; THENCE northwesterly at right angles to the last said line 60 feet to the northwestern line of said Market Street; THENCE northeasterly along the last said line 100 feet to said southwestern line of Fillmore Street; THENCE southeasterly along the last said line 60 feet to the BEGINNING. RESOLVED, FURTHER, that the portion of Market Street to be vacated and abandoned and the details of said vacation are more particularly shown upon that certain map known as Drawing 5155, Case 52, bearing the legend, "Abandonment of Market Street southerly of Fillmore Street", which map is hereby approved for the purpose of this proceeding and is hereby ordered filed in the office of the City Clerk of the City of Alameda and is hereby referred to for particulars as to the proposed vacation. RESOLVED, FURTHER, that the 1st day of MAY, 1962, at 730 o'clock p.m. of said day, in the COUNCIL CHAMBER in the CITY HALL, at the northwest corner of Santa Clara Avenue and Oak Street, Alameda, California, be, and the same is hereby fixed as the time and place for hearing by the Coun- cil of said City of all persons interested in or objecting to the proposed vacation. RESOLVED, FURTHER, that the City Clerk of the City of Alameda is hereby directed to cause this resolution to be published in the manner prescribed by law for the publishing of ordi- nances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in said City, and the official newspaper thereof. RESOLVED, FURTHER, that the City Clerk of the City of Alameda is hereby directed to post, or cause to be posted, conspicuously along the line of the street and parts of street proposed to be vacated, notices of such vacation, in the form and manner required by the legislative act here- inafter mentioned. RESOLVED, FURTHER, that in the herein proposed vacation of said street or portion of street aforementioned, the Council of the City of Alameda hereby elects to proceed under and in pursuance of the provisions of the Street Vacation Act of 1941 of the State of California (Chapter 250, Statutes of 1941), as amended. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 3rd day of April, 1962, by the following vote, to wit: AYES: Councilmen Godfrey, McCall, Rose, Schacht and President Collischonn, NOES: None.
