Resolution 06346CITY OF ALAMEDA RESOLUTION NO. 6346 RESOLUTION OF THE COUNCIL. OF THE CITY OF ALAMEDA ORDERING THE VACATION OF' A PORTION OF MARKET STREET, IN THE CITY OF ALAMEDA (SOUTH OF FILL('1ORE STREET). WHEREAS, the Council of the City nf Alameda did, on the 3d day of April, 1962, pass its Resolution of Intentabn No. 6341, declaring its intention to order the vacation, closing and abandon- ment of that certain porticn of Market Street, south nf Fillmore Street, in the City of Alameda, County of Alameda, State of California, more particularly described in said Resolution cr. Intention as follows: A parcel of land 60 feet wide, further described as follows: BEGINNING at the intersection of the southwestern line of Fillmore Street (formerly Webster Street) 60 feet wide, with the southeastern line of Market Street, 60 feet wide, as said lines and streets are shown on the "Map of Town of Alameda and Adjacent Lands" as surveyed by H. A. Higley and filed September 12, 1867, in Book 5 of Maps, at page 16, in the Alameda County Recorder's office; THENCE southwesterly along said southeastern line of Market Street 100 feet; THENCE northwesterly at right angles to the last said line 60 feet to the north- western line of said Market Street; THENCE northeasterly along the last said line 100 feet to said southwestern line of Fillmore Street; THENCE southeasterly along the last said line 60 feet to the BEGINNING: and WHEREAS, the portion of said Market Street to he vacated and abandoned and the details of said vacation are more particularly shown upon that certain map known as Drawing 5155, Case 52, hearing the legend "Abandonment of Market Street Southerly of Fillmore Street", which map was by said Resolution of Intention approved for the purpose of this proceeding and was ordered filed in the office of the City Clerk of the City of Alameda and marked "Filed Apr. 3, 1962", and which map was in said resolution referred to for further particulars as to the proposed vacation; and WHEREAS, the City Clerk of the City of Alameda caused said Resolution of intention to be published in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in said city and the official newspaper thereof; and WHEREAS, proof of said publication is evidenced by an affidavit of publication now on fife in the office of the City Clerk of said city; and WHEREAS, proof of said posting of such notice is evidenced by the affidavit of the person posting said notices, which affidavit sets forth the facts regarding such posting and is now on file in the office of the City Clerk of said City; and WHEREAS, the matter of said proposed vacation came on regularly for hearing before the Council of the City nf Alameda at its regular meeting nn the ist day of May, 1962, and at the time and place fixed in said Resolution of antention, and at such hearing the salt] Council heard the evidence offered by ail persons interested in said street vacation, and a full hearing thereon hav- ing beep, had and the matter submitted for determination; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that the street and parr thereof in said „Resolution of Intention and hereinbefore more particularly described is unnecessary for present and prospective public street purposes and that public interest requires the vacation of said portion of said street. BE IT FURTHER RESOLVED that the portion of said Market Street in said Resolution of Intention and hereinbefore mere particutarly described be, and the same is hereby vacated and abandoned. * * * a * a a * * 1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced acrd adopted by the Council of the City of Alameda in regular meeting assembled on the 1st day of May, 1962, by the following vote, to wit: AYES: Councilmen Godfrey, McCall, Rose, Schacht and President Collischonn, (5).
