Resolution 06424CITY OF ALAMEDA RESOLUTION NO. 6424 ORDERING THE VACATION OF PORTIONS OF WATERTON STREET, IN THE CITY OF ALAMEDA (WEST END OF WATERTON STREET). WHEREAS, the Council of the City of Alameda did, on the 20th day of November, 1962, pass its Resolution of Intention No. 6416 declaring its intention to order the vacation, closing and abandonment of those certain portions of Waterton Street, in the City of Alameda, County of Alameda, State of California, more particularly described in said Resolution of. Intention as follows: Parcel No. 1: BEGINNING at the intersection of the center line of Waterton Street (formerly Water Street), 60 feet wide,and the northwesterly line of the "Town of Alameda and Adjacent Lands" as said street and lines are shown on the "Record of Survey, Property of Sidney J. and Lillian A. Dowling", filed June 72, 1959 at page 111, Book 3 of Records of Survey, Official Records of Alameda County; THENCE along said northwesterly line North 42° 20' 07" East (based on the California Coor- dinate System, Zone III, as are ali bearings and distances in this description) 30.00 feet to the northeasterly line of said Waterton Street; THENCE along last said line South 47° 39 53" East 13.535 feet to a point; THENCE westerly and southwesterly along a non-tangent curve to the left having a radius of 40.00 feet (a radial line of said curve to last said point bears North 0° 55' 32" East.) through an angle of 48' 35' 25", a distance of 33.92 feet to the BEGINNING. Parcel No. BEGINNING at the intersection of the center line of Waterton Street (formerly Water Street), 60 feet wide, and the northwesterly line of the "Town of Alameda and Adjacent Lands" as said street and lines are shown on the "Record of Survey, Property of Sidney J. and Lillian A. Dowling", filed June 22, 1959 at page 111, Book 3 of Records of Survey, Official Records of Alameda County; THENCE southwesterly and southerly along a curve to the left having a radius of 40.00 feet Is radial line of said curve Co aforesaid intersection bears North 47° 39' 53" West and is coincident with said center line of Waterton Street) through an angle of 48° 35' 25", a distance of 33.92 feet to the southwesterly line of said Waterton Street; THENCE along last said line North 47" 39' 53" West (based nn the California Coordinate System, Zone III, as are all bearings and distances in this description) 13.535 feet to said northwesterly line of the "Town of Alameda and Adjacent Lands"; THENCE along last said line North 42° 20' 07" East 30.00 feet to the BEGINNING; and WHEREAS, the portions of said street to be vacated and abandoned and the details of said vacation are more particularly shown upon that certain map known as Drawing 5226, Case 54, bearing the legend "Abandonment of Parcels of Land at the West End of Waterton Street", which map was by said Resolution of Intention approved for the purpose of this proceeding and was ordered filed in the office of the City Clerk of the City of Alameda and marked "Filed Nov. 20, 1962", and which map was in said resolution referred to for further particulars as to the proposed vacation; and WHEREAS, the City Clerk of the City of Alameda caused said Resolution of Intention to be puhlished in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation puhlished and circulated in said City and the official newspaper thereof; and WHEREAS, proof of said publication is evidenced by an affidavit of publication now on file in the office of [he City Clerk of said City; and WHEREAS, proof of said posting of such notices is evidenced by the affidavit of the person posting said notices, which affidavit sets forth the facts regarding such posting and is now on file in the office of the City Clerk of said City; and WHEREAS, the matter oE said proposed vacation came on regularly for hearing before the Council of the City of Alameda at this, its regular meeting, on the 18th day of December, 1962, and at the time and place fixed in said Resolution of Intention, and at such hearing the said Council heard the evidence offered by all persnns interested In said street vacation; and a full hearing thereon having been had and the matter submitted for determination; NOV THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that the street and parts thereof in said Resolutinn of Intention and hereinbefore more particularly described are unnecessary for pre- sent and prospective public street purposes and that public interest requires the vacation of said portions of said street. BE IT FURTHER RESOLVED that the portions of said Waterton Street in said Resolution of Intention and hereinbefore more particularly described he, and the same are hereby vacated and abandoned. * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 18th day or December, 1962, by the following vote, to wit: AYES I Councilmen Godfrey, McCall, Rose, Schacht and President Collischonn, (5).
