Resolution 06455CITY OF ALAMEDA RESOLUTION NO. 6455 ORDERING THE VACATION OF THE SOUTH END OF HAWCHORNE STREET, IN THE CITY OF ALAMEDA. WHEREAS, the Council of the City of Alameda did, on the 5th day of March, 1963, pass its Resolution of Intention No. 6445, declaring its intention to order the vacation, closing and abandon- ment of the south end of Hawthorne Street, in the City of Alameda, County of Alameda, State of California, more particularly described in said Resolution of Intention as follows; A parcel of land, 60 feet wide BEGINNING at the intersection of the westerly line of Hawthorne Street, 60 feet wide, with the northerly line of Tract 1898 as said lines are shown on the map "Tract 1898, South Shore Unit No. 2, Alameda, California, filed August 22, 1958, at pages 89 to 92 inclu- sive, Book 38 of Maps, Official Records of Alameda County, said intersection having the coordinates of y 7 466,228.71 feet and x = 1,489,501.77 feet based on the California Coordinate System, Zone III, as are all bearings and distances in this description; THENCE along said westerly line North 2 46' 15" East 80.89 feet; THENCE South 61° 08' 30" East 66.81 feet to the easterly line of said Hawthorne Street; THENCE along said easterly line South 2' 46' 15" West 67.38 feet to said northerly line; THENCE along said northerly line North 72° 25' 00" West 62.06 feet to the BEGINNING; and WHEREAS, by said Resolution of Intention said Council declared and determined that public convenience and necessity require the reservation to the City of Alameda of a permanent easement and right-of-way over, across and under certain parcels of land situate in that portion of Hawthorne Street proposed to be vacated, for the purpose of constructing, operating, maintaining, replacing, renewing and repairing thereon storm and sanitary sewers, or either of them, and did by said Reso- lution of Intention reserve to the City cf Alameda, for the aforesaid purposes, a permanent easement and right-of-way over, across and under those certain parcels of land hereinafter described; and WHEREAS, the portion of said street to be vacated and abandoned and the details of said vacation, together with the easements to be retained, are more particularly shown upon that certain map known as Drawing 5271, Case 54, bearing the legend: "Abandonment of the South End of Hawthorne Street", which map was by said Resolution of Intention approved for the purpose of this proceeding and was ordered filed in the office of the City Clerk of the City of Alameda and marked "Filed Mar. 5, 1963", and which map was in said resolution referred to for further particulars as to the proposed vacation; and WHEREAS, the City Clerk of the City of Alameda caused said Resolution of Intention to be published in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in said city and the official newspaper thereof; and WHEREAS, proof of said publication is evidenced by an affidavit of publication ncw on file in the office of the City Clerk of said city; and WHEREAS, proof of said posting of such notice is evidenced by the affidavit of the person posting said notices, which affidavit sets forth the facts regarding such posting and is now on file in the office of the City Clerk of said City; and WHEREAS, the matter of said proposed vacation came on regularly for hearing before the Council of the City of Alameda at its regular meeting on the 2nd day of April, 1963, and at the time and place fixed in said Resolution of Intention, and at such hearing the said Council heard the evi- dence offered by all persons interested in said street vacation, and a full hearing thereon having been had and the matter submitted for determination; NOW, THEREFORE, BE IT RESOLVED MY THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that the street and part thereof in said Resolution of Intention and hereinbefore more particularly described is unnecessary for present and prospective public street purposes and that public interest requires the vacation of said portion of said street. BE IT FURTHER RESOLVED that the portion of Hawthorne Street in said Resolution of intention and hereinbefore more particularly described be and the same is hereby, vacated and abandoned. RESOLVED, FURTHER, that public convenience and necessity require the reservation of, and there is hereby reserved to the City of Alameda, permanent easements and rights-of-way over, across and under the following described parcels of land for the purpose of constructing, operating, main- taining, replacing, renewing and repairing thereon storm and sanitary sewers, or either of them; Said parcels of land being situate in the City of Alameda, County of Alameda, State of California, and more particularly described as follows: Parcel #I; A parcel of land 10 feet wide (for sanitary sewer), COMMENCING at the intersection of the westerly line of Hawthorne Street, 60 feet wide, with the northerly line of Tract 1898 as said lines are shown on the map "Tract 1898, South Shore Unit No. 2, Alameda, California", filed August 22, 1958, at pages 89 to 92 inclusive, Book 38 of Maps, Official Records of Alameda County, said intersection having the coor- dinetes of y 466,278.71 feet and x 1,489,501.77 feet based on the California Coordinate System, Zone III, as are all bearings and distances in this description; THENCE along said westerly line North 2° 46 15" East 27.69 feet to the TRUE POINT OF BEGINNING; THENCE continuing along said westerly line North 2° 46' 15" East 11.26 feet; THENCE South 59° 50' 15° East 36.57 feet; THENCE South 55° 20' 57" East 32.42 feet to the easterly line of said Hawthorne Street; THENCE along said easterly line South 2' 46' 15" West 11.77 feet; THENCE North 55' 20' 57" West 38.24 feet; THENCE North 59° 50' 15" West 31.00 feet to the TRUE POINT OF BEGINNING. Parcel #2: (For storm culvert) COMMENCING at the intersection of the westerly line of Hawthorne Street, 60 feet wide, with the northerly line of Tract 1898 as said lines are shown on the map "Tract 1898, South Shore Unit No. 2, Alameda, California" filed August 22, 1958, at page 89 to 92 inclusive, Nook 38 nf Maps, Official Records of Alameda County, said intersection having the coordinates of y 466,228.71 feet and x ° 1,489,501.77 feet based on the California Coordinate System, Zone III, as are all bearings and distances in this description; THENCE along said westerly line North 2° 46' 15" East 80.89 feet; THENCE South 61° 08' 30" East 3.40 feet to the TRUE POINT OF BEGINNING; THENCE continuing South 61° 08' 30" East 15.53 feet; THENCE South 42° 21' 47" East 39.50 feet to a line parallel with and 15.00 feet westerly at right angles from the easterly line of said Hawthorne Street; THENCE along said parallel line North 2° 46' 15" East 14.16 feet; THENCE South 61° 08' 30" East 5.57 feet to a line parallel with and 10.00 feet westerly at right angles from said easterly line; THENCE along last said parallel line South 2° 46' 15" West 69.63 feet to said northerly line of Tract 1898; THENCE along said northerly line North 72° 23' 00" West 5,17 feet to a line parallel with and 15.00 feet westerly at right angles from said easterly line of Hawthorne Street; THENCE along last said parallel line North 2° 46' 15" East 49.54 feet; THENCE North 42° 21' 47" West 59.18 feet to the TRUE POINT OF BEGINNING; and said parcels are hereby excepted from the vacation of said portion of Hawthorne Street, * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 2nd day of April, 1963, by the following vote, to wit: AYES: Councilmen Godfrey, McCall, Rose and President Colltschonn, (4).
