Resolution 06457CITY OF ALAMEDA RESOLUTION NO. 6457 DIRECTING THE MAYOR TO EXECUTE, ON BEHALF Of THE CITY, PURSUANT TO THE TERMS OF ORDINANCE NO. 1084 N. S., A RENEWAL OF THAT CERTAIN LEASE DATED APRIL 17, 1953, TO W. D. McELWAIN, SUBSE- QUENTLY ASSIGNED TO HARBOR TUG AND BARGE COMPANY. WHEREAS, on April 17, 1953, certain lands of the City of Alameda were leased to W. D. McElwain for a period of ten (10) years, pursuant to Ordinance No. 1084 N. S., duly passed hy the Council of the City of Alameda on March 17, 1953; and WHEREAS, as authorized hy Resolution No. 5885, adopted by this Council on January 20, 1959, W. D. McElwain assigned all rights under said lease to the Harbor Tug and Barge Company, a corporation; and WHEREAS, Ordinance No. 1034 N. S. and said Lease expressly provide that upon faithful performance of all terms and conditions of said Lease and upon the giving of written notice of intention to do so at least six (6) months prior to April 17,1963, Lessee shall have an absolute right to renew said lease for an additional period of fifteen (15) years; and WHEREAS, the Council is advised that W. D. McElwain and his assignee, Harbor Tug and Barge Company, have performed all terms and conditions of said Lease and that Harbor Tug and Barge Company has given timely notice of intention to renew same for the additional term of fifteen (15) years; and WHEREAS, in accord with the terms of the aforesaid Lease, providing for the renegotiation of annual rental in the event of renewal, a rental amount of 51,800.00 per year for the additional term has been proposed and accepted by Harbor Tug and Barge Company; and WHEREAS, a form of renewal lease containing the aforesaid rental figure of $1,800.00 per year has been prepared and submitted to this Council at its regular meeting held April 2, 1963, marked "Filed April 2, 1963", and ordered filed with the City Clerk; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA, that the form of Renewal Lease referred to above be, and the same is hereby approved. RESOLVED, FURTHER, that the Mayor of the City of Alameda be, and he here's}, is directed to execute, on behalf of the City, a renewal lease substantially in the form and containing the terms, covenants, agreements and provisions set forth in the aforementioned form of Renewal Lease, and the City Clerk is directed to attest the same. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 2nd day of April, 1963, by the following vote, to wit: AYES: Councilmen Godfrey, McCall, Rose and President Collischonn, (4).
