ORDERING THE VACATION OF TWO EASEMENTS FOR FUDLIC PURPOSES
(SE‘a:,12). (TRACT 2537, SOUTd SHORE, UNIT IV).
BE IT RESOLVED BY THE COUNCIL OF TIE CLTY OF ALAMEDA Lham that certain easement. heretofore
dedicated for public purposes, being situate in the City of Alameda, County of Alameda, State of
California, and more particularly described as follows.
A portion of the easement conveyed by Ruth E, Cornick, Arnold E. Cornick, her
husband, et al, to the City of Alameda by Deed dated 3-31118 18 4, 1918 and recorded
janary 5, 1938 in Book 3579 of Official Records of Alameda Counmy. at page 187,
and furthex desaribed as follows:
BEINNING am a point South 56 50' 30" East 282.67 feem and South 37' 23° 00 West 203.00
feet from a point on the southwestern line of Otis Drive, formerly Bay island Avenue,
last said point being the most northern corner of Block "I" as said Avenue and Mock
are shoun on the "Plat of the Lewelling Division', filed October 18, 18S7, in Map
Book 19, page 67, Alameda County Records;
THENCE South 37' 23' 00" West 188.80 feet;
THENCE westerly on a curve tO the right 11 ,€ to last said line and having a radius of
10.00 feet a distance on said curve of 14.97 feet,
THENCE South 56 50' 30" East 65.44 feet;
THENCE North 37° 23' 00' East 198.19 feet;
THENCE North 56' 50' 30" West 56S00 feet,more or less, to the point of BEGINNING;
EXCEPTING THEREFROM, all that portion thereof lying within the easement described in the
Grant of Easement between Alameda Soutr.h Shore Laad Company and the City of 181198, 91161!
May 31, 1951 and recorded june 11, 1951 in Book 6431 of Official Records of Alameda County,
at page 197,
is hereby ordered vacated pursuant to the provisions of Section 50443 of the Government Code of the
State of California.
BE IT FURTHER RESOLVED that that certain easement heretofore dedicated for public purposes,
being situate in the Cir,y of Alameda, County of Alameda, StaLe cf. California, and more particularly
described as follows:
All Lhat portion of the sewer easemen described in the grant from M. F. Bishop and
Edward P. Hart 10 113 City of Alameda, recorded May 4, 1.886 in Book 301 of Deeds, page 337,
Alameda County records, lying within the 1) 16l68'113 of Lot 2 as said Lot is shown on the
Record of Survey filed September 11, 1961 in Book 4 of 84 '3 of Surveys, page 28, Alameda
County records;
EXCEPTING THEREFROM, any portion thereof lying within the easemence granted by South
Shore Land Company to the City of Alameda, recorded September 5, 1961 on Reel 401, Image 273,
and Reel 4.01, image 281, of Official Records of Alameda Cosnty,
is hereby ordered vacated pursuant to the provisions of Section 50443 of the Goverment Code of the
State. of California,
'3 IT FURTHER RESOLVED that she Council of the City of Alameda hereby finds and declares
that (1) the easements ordered vacated herein are unnecessary for present or prospective public use,
and (2) the easement hereinabove first described was dedicated and accepted by the City of Alameda
on January 4, 1938, and the second on May 4, 1886, and neither said easement has been used by the
City for any purpose whatever since the respective date of its said dedicaLion and aeceptanue, to
the date of this resolution—
the undersigned, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the
21st day of January, 1964, by the following vote, to wit:
AYES: Councilmen Freeman, La Croix, Jr., McCall, Rose and President Godlrey, (0).
NOES; None.
ABSENT: None.
