CAUSE A CERTIFIED COP'.e OF THIS RESOLUTION RECORDED, WHEREAS, the Council of the City of Alameda did, on the 3rd day of June, 1964, pass its Resolution of Intention No. 6632 declaring its intentiin Lo order the vacation of an unimproved roadway Or street previously acquired by the City of Alameda by instrument recorded May 36, 1963, RE: 885, at: '6 (.A.0 83234), Alameda Cotinty Records, frm 'Buena Vista Apartments, Inc.., a California corporation, located on the extension of 'Fifth Street northerly of Buena Vista Avenue, in the City of Alameda, County of Alameda, State of California, more part:icularly described in said Resolution of Intention as follows; BEGINNING at a point on the northern line of Buena Vista Avenue, distant thereon north 87. 07' 12" west 14,56 feet westeTly of the intersection. of. said northern. line wito. the center line of Fifth Street: extended northerly, said point having coerdAnates of Y-470,0/3.1.3 feet and X-1,485,239.57 feet based upon the California Coordinate :-.;ystem, Zone Z. as are all. bearings and distances in thi.,; description; thence north. 20 48' 3Cm east 775.82 feet to the line segregatinE: tha high. land and the marsh land, as said line is shown on. the Map of Alameda Marsh Land as partitioned among the owners therenf in. the S,lit No. 8923, entitled! "Pacific Improveaant Company, plaintiff. vs. JaaK..-s A. Waymire, et. al., defendants", Superior Court, Alameda County, filed july 30, 1900 in Book 25 of Maps, pages 74 tc. 78, inclusive, in the office of the County Recorder of Alameda County; thence along the last mentioned line, sou.t.h 850 25' 08' east 30.02 feet to a line drawn parallel. with the above mentioned line designated as 'north 2. 4.8' 30" east. 775.32 feet', and distant at right angles 30 feet easterly therefrom; thence along said parallel line, south 2° 48 30' west 774.93 feet to said northern line of Buena Vista Avenue; thence along said northern, line, north 87'-' 1. 12' west 30 It to the point. of 1)eginn'.ng; subject, however, co the reservatlon in the City of Alameda, pursuant to the provisions of Sections 8330 and 8231. of the Streets and Highways Cnde of California, of the permanent easement and right of way at any time, or from time to time, to construct, maintain, operate, replace, renew and remove sanitary se,.:ers, storm drains and sewers, and any and all public utilities, and appurtenant struc- tures, in, over, under, along and across said street, including the rigrAt. Of convenient access, and the right to keep the property free from flaMmable materials and wood growth, and otherwise protect the same from all hazards, in, upon and over the street proposed to be vacated; and WHEREAS, particulars oi the proposed vacation are 111 on that certain map entitled, "Proposed Vacation of a Certain Unimproved Roadway or Street Located on the Extension of Fifth Street Northerly of 6uena Vista Avenue on file i1 . the office of the CiCy Clerk; and' HEREAS, the City Clerk of the City of Alameda caused said Resolution of intention to be duly published and notice thereof and of the time and place of hearing thereon was duly posted in accordance with the requirements of Part, 3 of Division, 9, of the Streets and Highways Code of California; and WHEREAS, proof of said publication is evidenced by an affidavit of publication now on file in the office of the City Clerk of' said City; and WHEREAS, proof of said posting of such notices is evidenced by the. affidavit of the person posting said 11, and is now on. file in the office of the City It of said City; and WHEREAS, the matter of said proposed vacation camf.: on regularly for hearing before. the Council of the City of Alame.da at this, its regular meeting, on the 7th day of jUiy, 1966, and at the time and place f.i.xed in said Resolution of intention, and at such hearing the said Counci1 . beard the evidence offered by all persons interested in said street vacation; and a foil hearing thereon having been had and the matter submitted for determination; NOW THEREFORE, BE 5, RESOLVED BY THE COUNCIL, OF' THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that the street in said Resolution of Inten- tion and hereinabove more particularly described is unnecesary for present and prospective public street purposes and that public interest requires the vacation of said street. 1 IT FURTHER RESOLVED that the street in said Resolution of Intention and hereinbefore more particularly described be, and the same is hereby vacated, subject, however, to the reservation in the City 1' Alameda cf. the easement and right-of-way L'1'14 110 set forth. BE IT FURTHER RESOLVED that the City Clerk in hereby directed to have a certified copy of this Resolution recorded in the office of the Recorder of Alameda County, California. cq 1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly ntroduced and adopted by the Council of the City ot Alameda in regular meetinR assembled on the 7th day of :July, 1964, by the following vote, to wit: AYES: Councilmen Freeman, La Croix, Jr., McCall, Rose and President Godfrey, (5).
