Resolution 06785CITY OE ALAMEDA RESOLUTION NO, 6?85 OEDERTNC VACATION OF THREE UNUSED PUBTIC SERVICE EASEMENTS (VACATED PORTION OF MARKET STREET, SOUTHERLY OF MADISON STREET): WHEREAS, on December 18, 1962, pursuant to Part 3, Division 9, Streets and Highways Code of California, a portion cf Market Street southerly of Madison Street, in this city. was duly vacated and three (3) certain public service casements were reserved from said vacation, and WHEREAS, said vacation and reservation was recorded on December ao, 1962, in the office of the County Recorder of Alameda County under Series AT 175062, RE: 753, ['1: 409, 410, 411 and 412; and WHEREAS, said easements so reserved are unnecessary for present or prospective public pur- poses, and this Council accordingly finds they should be vacated; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the certain ease- ments heretofore by Resolution No. 6425 reserved to the City for public purposes, being situate in the City of Alameda, County of Alameda, State of California. and more particularly described as follows: PARCEL ffrlt PARCEL #2i PARCEL #3: A strip or parcel of land 10.00 feet wide (for sanitary sewer), COMMENCING at the point of intersertion cf the northwesterly line of Market Street, 60 feet wide blow abandoned) with the southwesterly line of Madison Street, 60 feet wide, as said lines and streets are shown on the "Map of Tow, of Alameda and Adjacent Lands" as surveyed by H. A. Higley and filed September 12, 1867 in Book 5 of Maps, at page 16, in the Alameda County Recorder's office; THENCE southeasterly along the direct extension of said southwesterly line of Madison Street 25 feet to a point on a line drawn parallel with and 25 feet southeasterly at right angles £,n- said northwesterly line of Market Street; said point Is the TRUE POINT OE BEGINNING; THENCE continuing southeasterly along said direct extension 10 feet to a line drawn parallel. with and 35 feet southeasterly at right angles from said northwesterly line of Market Street; THENCE southwesterly along last said parallel line 85.93 feet; THENCE westerly on a line defleuting 45 to the right from last said line 14.14 feet to the aforesaid line drawn parallel with and 25 feet southeasterly at right anEles from said northwesterly line of Market Street; THENCE northeasterly along last said parallel line 95.92 feet to the TRUE POINT OF BEGINNING. A strip or parcel of land 10.00 feet wide (for gas main), BECINNINC at the point of intersection cf the northwesterly line of Market Street, 552 feet wide, with the southwesterly line of Madison Street, 60 feet wide, es said lines and streets are shown on the "Map of Tow, of Alameda and Adjacent Lads" as surveyed by H. A. Higley and filed September 12, 1867 in Book 5 of Maps, at page 16, in the Alameda County Recorder's office; ThENCE southeasterly along the direct extension of said southwesterly line of Madison Street 10 feet to a line drawn parallel with and IC feet southeasterly at right angles: from said northwesterly line of Market Street; THENCE southwesterly along said parallel line 110 feet; THENCE northwesterly at right angles to said parallel line 10 feet to the aforesaid northwesterly line of Market Street; THENCE northeasterly along last said tine 110 feet to the BEGINNING. 5 strip or parcel of land 10,00 feet wide (for power line,), COMMENCING at the point of intersection of the northwesterly line of Market Street, 60 feet wide, with the southwesterly line of Madison Street, 60 feet wide, as said lines and stxeets are show, on the 'Map of Town of Alameda and Adjacent lands" as surveyed by H. Higley and filed September 12, 1867 in Book 5 of Maps, et page 16, in the Alameda County Recorder's office; THENCE southeasterly along the direct extension of said southwesterly line of Madison Street 4 feet to a point on a line drawn parallel with one 4 feet southeasterly et right angles from said northwesterly line of Markel Street; said point is the TRUE POINT OF BEGINNING; THENCE continuing southeasterly along said direct extension 10 feet to a line drawn parallel with and 14 foot southeasterly et right angles from said northwesterly line of Market. Street; THENCE southwesterly along laSt said parallel line 20 feet; THENCE northwesterly at right angles to said parallel line 10 feet to the aforesaid lire drawn parallel with and 4 feet southeasterly at right angles from said northwesterly line of Market Street, THENCE northeasterly along test said parallel line 20 feet to the TRUE POINT OF BEGINNING, 4 -( are hereby ordered vacated pursuant to the provisions of Section 50443, Government Code of California. BE IT FURTHER RESOLVED that the Council of the City of Alameda hereby finds and declares that (1) the easements herein ordered vacated are unnecessary for present or prospective public use, (2) said easements were acquired as aforesaid on December 18, 1962, have not been used continu- ously sines said date, and have not been used at all for any purpose for more than one year immed- iately preceding the date of this order vacating them. * * * * * * * * * * 1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alaneda in regular meeting assembled on the 4th day of May, 1.965, by the following vote, to wit: AYES: Councilmen Bartley, La Croix, Jr,. bcCali and Vice President Rose, (4).
