AUTGORIDANC EXECUTION OF AGREEMENT FOR CONSTRUCTION AND
COMPLETION OF IMPROVEMENTS IN CONNECTION WITH PROPERTY
DIVISION MAP NO, 153 AND APPROVING DEPOSIT OF CERTIFIED
CHECK AS TO SUFFICIENCY IN LIEU CF SURETY PERFORMOKCE

WEEREAS, pursuant to Section 11-319.1 of the Alameda Municipal Code, there has been pre-
sented to this Council a Property Division Map, designated Property Division. Map No, 153, and here-
tofore conditionally approved by the Planning Board, being a division of the property located at
the southeast. corner of Otis Drive and Willow Street, in the City of Alameda. by S. J. Dowling 66
Son, Inc.; and
KBEREAS, said approval by the Planning Board is conditioned upon the execution by sub-
divider of an. agreement to construct and complete certain public improvements on said property; and
'WHEREAS, said subdivider has entered into such an agreement. and has posted and deposited
in lieu of a surety performance bond, its certified check in the sum of $2,000.00 guaranteeing full
and faithful performanne of said work, all in accordanne with said sectiony and
WE:OKRAS, it 4911. be to the benefit of the City to have said work performed in accordanne
therewith:
0 THEREFORE, BE IT RESOLVED BY THE COUNCIL Og' THE CITY OF ALAMEDA that the agreement
for the construction and completion of the improvements in the division of property located at the
southeast corner of Otls Drive .1100 Willow Street, designated as Property Division Map No. 153, by
Dowling & Son, Tina., be and the same hereby is, approved, and the City Manager is authorized
and directed to execute: and the City Clerk to attest, said agreement on behalf of the City; and
BE IT FURTRER RESOLVED that said certified check, in lieu of a performance bond, is hereby
approved as sufficient in amount.
I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted by the Council. of the City of Alameda in regular meetgns assembled on the
7th day of September, 1005 by the following vote, to wit:
