Resolution 06882CITY OF ALAMEDA RESOLUTION NO. 6882 AUTHORIZING, EXCHANGE OF REAL PROPERTY WITH THE REGENTS OF THE UNIVERSITY Of CALIFORNIA. WHEREAS, by deed executed January 13, 1940, for a consideration of One Dollar (51,00), The Regents of the University of California granted certain real property to the City for street purposes, which property became and now is an 30-foot improved public roadway known es Main Street; and WHEREAS, said deed provides for reversion of any part of said property not used for street purposes, and there now exists a small portion thereof not so used, lying along the easterly line of said Main Street at and near the intersection thereof with Singleton Avenue, said portion referred to as Parcel "A" and Parcel "B" as shown on City Engineer's Drawing No, 5719, Case 54, to which refer- ence is hereby made; and WHEREAS, said Parcel 'A" is unnecessary for City street Or other purposes but Parcel '3" is necessary for the better alignment of said intersection, and it is in the City's interest to acquire said Parcel 'T0 free and clear of the reversionary interest of the said grantor, which is willing to convey same to City; and WHEREAS, it is proposed that Parcel "A" he conveyed to The Regents by the City, and that Parcel "13' be conveyed to the City by The Regents. and that said exchange he without the payment by either party of other consideration; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that in consideration of the conveyance to the City of said Parcel 13", there is hereby authorized the conveyance, by quit- claim deed, ro The Regents of the University of California, a corporation_ by the City of the follow- ing described property: PARCEL. 'A" (Southeast corner of Main Street and Singleton Avenue) A parcel of land Situate in the City of Alamado, County of Alameda, State of California, and further described as follows: BEGINNING et an angle point in the easterly line or the parcel of land described in the Deed from The Regents cf the University of California to the City of Alameda recorded February 3, 1940, at page 386, Book 3861, Official Records cf Alameda County, said angle point being South 28° 49' East 839.94 feet from Station #178 on the 'Pereira Grant Line, THENCE along said easterly line South C. 34' East 261.71 feet to a point of cusp with a tangent curve concave to the west haying a radius of 1040 feet, drawn parallel with and 80.00 feet easterly, radially, from the westerly line of said parcel.; THENCE northerly, through an angle of 17° 16' 04", along said curve 313.44 feet; THENCE northeasterly along a reverse curve concave to the southeast having a radius of 20 feet (through an angle of 77' 20' 02") a distance of 26.99 feet to said easterly tine of said parcel; THENCE along said easterly line South 28. 49' East 79.77 feet to the BEGINNING. BE IT FURTHER RESOLVED that the said Regents be requested Co execute a like conveyance to the City of the following property: PARCEL "B" (At the intersection of Main Street and Singleton Avenue) A parcel of land situate in the City of Alameda. County of Alameda, State of California, and further described as follows: COMENCING, at an angle point in the easterly line of the parcel of land described in the Deed from The Regents of the University of California to the City of Alameda recorded February 3, 1940, at page 386, Book 3861, Official Records of Alameda County, said point being South 28' 4.9' East 839.94 feet from Station 13178 on the Peralta Grant Line: THENCE along said easterly line North 2530 49' East 79.77 feet to the TRUE: POINT OF BEGINNING: THENCE southwesterly and southerly 26.99 feet through an angle of 77° 20' 02" along a non- tangent curve having a radius of 20 feet (a radial tine of which curve through the TRUE POINT OF BEGINNING bears North 300 30' 02" West) to a point of cusp with a tangent curve concave LD the west having a radius of 1,040 feet, drawn parallel with and 8C.00 feet easterly, radially, from the westerly line of said parcel; THENCE along said curve northwesterly 199.34 feet (through an angle of 10' 58' 56") to a point of cusp with said easterly line of said parcel; THENCE along said easterly line South 28° 49' East 181,94 feet to the TRUE POINT OF BEGINNING.
