Resolution 06924204 CITY OF ALAMEDA RESOLUTION NO, 6924 FINDING AND DETERMINING THE CERTAIN UNIMPROVED PORTION OF MECARTNEY ROAD EAST OF CAMELLIA DRIVE, REFERRED TO IN RESOLUTION NO. 6916, IS UNNECESSARY FOR PRESENT OR PROSPEC- TIVE STREET PURPOSES; FINDING NO RESERVATION OF EASEMENT THEREIN NECESSARY; ORDERING THE VACATION THEREOF', 860 DIRECTING CITY CLERK TO CAUSE A CERTIFIED COPY OF THIS RESOLUTION TO BE RECORDED. WHEREAS, the Council of the City of Alameda did, on February 15, 1966, pass its Resolution of Intention No. 6916 declaring its intention to order the vacation of an unimproved portion of a public street, being a strip fi.ve feet wide by one hundred forty-four feet long, of Mecartney Road east of Camellia Drive, situated in the City of Alameda, County of Alameda, State of California, and more particularly described as follows: COMMENCING at the monument at the intersection of the monument lines of Mecartney Road and Camellia Drive as said monument, Road and Drive are shown upon that certain map entitled 'TRACT 1250, ALAMEDA, ALAMEDA COUNTY, CALIFORNIA," filed for record March 29, 1955, in Book 35 of Maps, Page 78, in the office of the County Reeorder, Alameda County, California, said monument having coordinates Y.454,406.75 feet and X.1,497,876.57 feet based on the California Coordinate System, Zone 3, as are all bearings and distances in this description; THENCE along said monument Rue of Camellia Drive, South 34' 03 27" West 25.91 feet. to Boardman's Tide Land Line; 8118806 along said Boardman's Line South 72° 56' 02" East 45.71 feet to the True Point. of Beginning, said point being the point of intersection of said Boardman's Line with a non-cangene circular curve, the tangent at said point of intersection bearing North 69e 31' 22'' Eest; THENCE easterly along said curve, concave to the south, haying a radius of 20.00 feet, through a central angle of 33° 36' 10", for an are length of 11.73 feet; THENCE along a tangent to the last described curve, South 75" 52' 28" East 9.00 feet; THENCE southeasterly along a tangent curve, concave to the southwest, having a radius of 586.00 feet, through a central angle of 120 12' 50", for an arc length of 124.92 feet to said Boardman's Line; THENCE along said Boatdman's Line North 72' 56' 02" East 144,38 feet to the True Point of Beginning; (Containing 0.012 acres of land, inure er less) and in said Resolution found and determined that public convenience and necessity do not require reservation by said City of any easements or rights of way in said portion of said street; and WHEREAS, particulars of the proposed vacation are shown on that certain. map entitled, "Abandonment of a Portion of Mecartney Road, East of Camellia Drive," on file in the office of the City Clerk and being City Engineer's Drawing No. 5800, Case 54; and WHEREAS, the City Clerk of the City of Alameda caused said Resolution of Intention to he duly published and notice thereof and of the time and place of hearing thereon was duly posted in accordance with INC requirements of Part 3 of Division. 9, of the Streets and Highways Code of California; and WHEREAS, proof of said publication is evidenced by an affidavit of publication now on file in the office of the City Clerk of said City; and WHEREAS, prnof nf said posting of such notices is evidenced by the affidavit of the person posting said notices, and is now on file in the office of the City Clerk of said City; and WHEREAS, the matter of said proposed vacation came on regularly for hearing before the Council of the City of Alameda at this, its regular meeting, an the 15th day of March, 1966, and at the time and place fixed in said Resolution of Intention, and a: such hearing the said Council heard the evidence offered by all persons interested in said street vacation; and a full hearing thereon having been had and the matter submitted for determination; NOW THEREFORE, BE IT RESOLVED By THE COUNCIL OF THE CITY OF ALAMEDA that said Council hereby finds and determines, from all the evidence submitted, that the street in said Resolution of Intene tion and hereinbefore mere particularly described is unnecessary for present and prospective public street purposes and that public interest requires the vacation of said street. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have a eereified copy of this Resolution recorded in the office of the Recorder of Alameda County, California. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City 0F Alameda in regular meeting assembled on the 15th day of March, 1966, by the following vote, to wit: AYES: Councilmen liartley, La Croix, Jr., McCall, Rose and President Godfrey, (5).
