SCSPENDIN1, OPERATION OF CONTRACT NO. Ps: 1-6681 FOR FAILURE
OF CONTRACTOR TO PROSECUTE WORK THEREUNDER (CULVERT REPLACE-
MENT, FERNSIDE 300LEVAR1) AND LIBERTY AVENUE—CLIFFORD W. :iSREER).
WHEREAS, in accordance with City's "Specifications, Special Provisions and Plans, Replace-
ment of Existing Culvert at Fernside Boulevard and Liberty Avenue, No. 9) 1-31'-] a contract for
performance of said public work was entered into between the City and Clifford W. Greer on March 3,
966; and
WHEREAS, said Contractor has failed; refused and neglected to perform the work under said
contract, either within the time specified therein or at ell, and this Council finds and determines
he is in default thereunder and that the operation thereof ought to be suspended, a11. as provided
for in said Specifications and Contract;
NOW THEREFORE, BE rr RESOLVED BY THE CO. OF THE CITY OF ALAMEDA that the operation of
the public works contract hereinebove referred to is hereby suspended for failure of Clifford W.
Greer, Contractor, to comply with and to prosecute work thereunder; and
BE IT FURTHER RESOLVED that the City, by and through its City Engineer, shall undertake
control of said work in accordance with Section VI of said Speolficationm and shall make appropriate
charges and demands agaiomt said Contractor, and against his surety, Hartford AccidainM and. indemnity
Company, under its Faithful Performance Bond No. 3281309.
