WHEREAS, in. accordance with the Clty's Specifications, Speci.al Provisions ape, Plans,
Culvert Reconstruction at Sixth Street and Height Avenue, No. PW 11-65-30, a contract for per-
formance of said public cork was entered into Between the City and Clifford W. Greer on Dezember

WHEREAS, said Contractor has falledIrefused and neglected to perform the work under said
contract, either within the time specifled therein or at all, and this Council finds and detercEnes
he is in default thereunder and that the operation thereof ougEt to be suspended, all. as provided for
in said Specifications and Contract;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OR' ALAMEDA that the operation. of
the public 11 (0111 hereinabove referred to is hereby susPended for failure of Clifford. W.
Greer, Contractor, to comply with. and to prosecute work thereunder, and
BE IT FURTHER RESOLVED that the City, by and through its City Engineerp shall undertake
control of said amrk In accordance with Sectiox VI of said SpecifiNations and shall. make appropriate
charges and demands against said Contractor, en 13 ainst his surety, Hartford Accident and Indemnity
Company, under its Faithful Performance Bond No. 3280783,
