AHEEORIZING EXECUTWON OF' AGREEMENT FOR CONSTRUCTION AND
COMPLETION OF IMPROFEMENTS IN CONNECTION MITE FARCE, MAP
NO. 259 AND APPROVING CASH DEPOSIT AS To SUFFICIENCY IN
LIEU OF GURNEY PERFORMANCE BOND (1207 SHERMAN STREET --
DONAU R. AND PATRICIA M. PITNER).
WHEREAS, pursuant to Section, 11-319-1 of the Alameda FMhdeipall Code, there has been pre-
sented to this Council a Parcel Hap, designated Parcel Map No. 259, and heretofore conditionally
approved by the Planning Board, being a division of the property located at 1207 Sherman Street, in
the City of Alameda, by' Donald F. Eitner and Patricia , M. Ditner; and
WHEREAS, said approval by the Planning Board is conditioned upon the execution by subdivider
of an agreeawrt to construct and cempuetb certain public improvements on said property; and
WHEREAS, said subdivider has entered into such an agreement. and has posted and deposited
in lieu of a surety performance bond a cash, bond in the sum of $200.00 guaranteehng full, and faith-
ful, performance of said work, all in accordance with said section; and
WEEREAS, it will be to the benefit of the City. to have said work performed in accordance
therewith;
NOW THIBEFORE, BE IT RESOIMET BY WEE COUNCIL OF THE CITY OF' ALAMEDA that the amreement for
the construction. and completion of the improvements in the division of property' located at 1207
Sherman Street, designated as Parcel Map No. 259, by Donald B. blitner and Patricia, M. Piffles., be,
and the same hereby is, approved, and the City Manager ie authorized and directed to execute, and the
City Clerk to attest, said agreement on behalf of the City; and
