CONSENTING, TO ASSIGNMENT OF LICENSE AGREEMENT GRANTED BI-
ORDINANCE NO. 1465, NEW SERIES (BERNHARD & ASSOCIACTS TO
PAN-PACIFIC DEVELOPMENT' COMPANY).
WHEREAS, Ordinance No. 1445, hehr Series, enacted June 3, 196) , authorized a License Agree-
ment between the City and Bernhard & Associates, thereafter executed October 6, 1964, and granted
certain development rights to said Bernhard & Associates; and
WHEREAS, said Licensee desires to transfer, set over and assign all its rights and obliga-
tions thereunder to Pan-Pacific Development Company, a California corporation, and the said. parties
have executed a form of Assignment and have presented same to this Council for its consent as
required by Part III, paragraph (i) of said License Agreement; and
WHEREAS, it ih in the best pubiRc ihterest that said. consent be given in order that, among
other things, the development contemplated under said ofdinance and License Agreement be continued
and completed. according to the tenor thereof;
NOW, IFIEETORE, BE II' RESOLVED BY TEE COUNCIL OF THE CITY OF ALAMEDA:
(1) lhat the Assignment of license Agreement executed on. Mane 1.9, 1967, between
Bernhard 6.7. Associates and Pan-Pacifio Development Company, a copy of which is attached hereto, is
approved, and this Council does grant its consent thereto in accordance with the terms of said
Assignment;
(2) That Pan -Pacific Development Company shall. furnish the City- satisfactory evidence
of performance guarantees and insurance coverage required. of the licensee by said License Agree-
ment or otherwise, and that thereupon the like guarantees and. coverage heretofore furnished by
Bernhard Associates shall be released;
(3) That the Fill Permits heretofore on February 4, 1964, issued Bernhard & Asseciotes
by the City pursuant to Sections 9-311. and following of the Alameda Municipal Code be and hereby
are transferred. to Pan-Pacific Development Company upon. the furnishing by the latter 13 +1 bonds
required by said sections.
