Resolution 07176CITY OF ALAMEDA RESOLUTION OF INTENTION NO. 7176 IN THE NATTER OF THE CONSTRUCTION OF IHDROVIMENTS TN ASSESSMENT' DISTRICT' RO. 67-1, CITI OF ALAMEDA, AIMIDA COUNTY, „CALIFORNIA. BE IT RESOLVED by the City Council of the City of Alameda, kkaneda Counts}m California, that it is the intention of said City Council to order the following Improvements to be made in the City of Alameda, Alameda County California, to wit: The construction of stmeet improbements in Court Street from Calhoun Street to Fillmore Street; Fillmore Street from Court Street to Nigh Street; High. Street from Fillmore Street to Washington Street; South Half of Calhoun Street from High Street to a point 101. , East of Post Street; Peach Street from Calhoun Street to FRIIMpore Street; Adams Street from Post Street to Peach Street; Pearl Street from Otis DriVe to a point 901 South of Otis Drive; and the construction of all neces- sary appurtenances for the above described streets; BE IT RESOLVED that said improvements to be cnstramted in the streets, avenues, lanes, courts, roads, places and/or public ways hereinabove described, will be of the dimensions, materials, and in the particular locations, as set forth and shown on the plans and specifications and dotailbd drawings hereinafter referred to; together with the construction of all appurtenances thereto, including necessary fittings, trenchings, grading and regrading, excavation and fill, removal. of obstructions, connections to existing services, back filling, reconstruction of' existing ground surface as required to conditions existing prior to commencement, of construction, all. .13 110 manner, of the materials, and to the dimensions and to the grades, and in the particular locations as the same will be more fully shown on the plane and specifications and detailed, drawings hereinafter referred to; That the structures and work and improvements herein described shall be constructed to the grades, sub-glades and elevations severally to be shown upon the plane and profiles and detailed drawings thereof in the respective locations thereof, which said grades are Hereby- adopted as the official grades therefor for all purposes in cormection with the proceedings pursuant to this Reso- lution of Intention. 1+ 05 is hereby given that said grades may be new and different from those heretofore established or existdng, or may be different from existing ground levels. All of1 said work sha» l. include, without duplication, any and a street intersections, terminations and opposite terminations ocouring within the limitations of +5 01 work. The attention of all persons iB directed to the fact that no all of said classes of work above described may be constructed upon all the streets and/or public ways '0033 0133-0113 in their entirety, but only upon the particular locations as sho0 n. on the plans and specifications hereafter referred to, which said plans and specifications shall govern as to all details with relation to the same. DE IT FURTHER RESOLVED that tho City Council of the City of Alameda hereby makes the expenses and costs of said improvements chargeable upon a district, which said district said City Council. hereby declares the district benefited by the improvements herein described.; said, district shall include that, territory in the City of Alameda, Alameda County, California, which is shown on that certain map on file in the office of the City Clerk of the City of Alameda, and which is entitled and described, (Proposed Boundaries of Assessment District No. 67-1, City of' Alameda, Alameda County, California,11 and which said rap indicates by a boundary line the extent of the terri- tory included in the proposed distrixt and covers all details as to the extent of the area to be assessed; said. map fa, by this reference, incorporated herein and made a part hereof. Exoepting from the area shown and delineated on said. map hereinanove referred to, the area of all public streets, avenues, lanes, roads, drives, courts, places, public parks, and all ease- ments and rights-of-way therein contained belonging to the public, and also 1 roperty owned by the City of Alameda, the County of :Alameda, the State of California, or the United States of America, contained therein, now in use in the perfoImance of a public function. NOTICE IS REEEDY GIVEN that serial bonds to represent unpaid assessments, and bearing interest at the rate of not to exceed six (6%) per cent per annfun shall be issued In the manner and form provided in Part 5, Division 7, of the Streets and Righuays Code of the State of California, (Improvement Act of 1911) to represent unpaid assessments of Fifty Dollars ($50.00) or over, the last installment of which bonds shall ,,at +.'c fourteen (14) years from the 2nd day of Innaary next succeeding the neXt September 1st following their date. Said bonds shall, be payable to bearer, and may be redeemed as provided in the Ihprovement Act of 1711, and there shall be added. to the redemp- tion dense in said bonds the following words: (.......together with a premium. of five per cent (5%) of the '(5 red principal.( Proceedings for all work shall be taken pursuant to the Nunioipel Improvement Act of 1913, and the bonds hereinabove described shall be issued under the provisions of the Lnprovement Act of 1D11, as heretofore described. BE MT FUR= RESOLVED that, in accordance with the provisions of Sections 1020S and 10204 of the Streets and Highways Code, being a part of the BUnicipal Improvement Act of 1D13, the matter of the imProvements herein referred. to is hereby referred to the Citp Engineer of the City of Alameda, and the person in charge and control of the improvements described in thns resolution_ Said City Engineer de hereby directed to make and. file wMth the City Clerk of the City of Alameda a report in writing containing the following: a. Plans and specifications of' the proposed improvement if the 13 rovement is not already installed; b. A general description of the works or appliances already- installed and any other property necessary or convenient for the operation of the improvement, if the works, appldances or property are to be constructed as part of the improvement; c. An estimate of the cost of the improvements and of the cost of lands, rights—of- wayw easements and incidental expenses in connection with the improvements; d. A diagram showing the assessment distriot and the boundaries and dimensions of the subdivisions of and within the district as they existed at the time of the passage of the Resolution of Intention, Each subdivision sha ll. be given. a separate number upon the diagram; e. A proposed assessment of the total amount of the cost and expenses of the proposed improvements upon the several subdivisions of land in the district in proportion to the estiroted benefits to be received by each subdivision, respectively, from the improvements. BE IT FERN= RESOLVED that if any surplus remains in the Improvement Fund after the, completion of the improvement and the payment of all claims 0.00 the improvement FUnd, said surplus shall be transferred to the general.. fund of the City if it does not exceed. the lesser of $1,000.00 or five per cent (5%) of the total amount- expended from the Improvement Fund; otherwise said SUT- plus shall be applied as a credit upon the assessment in the manner provided in Section 10427.1 of the Streets and :Highways Code.
