Resolution 07302CITY OF ALAMEDA RESOLUTION NO. 7302 GRANTING PERALTA jUNIOR COLLEGE DISTRI( T' REVOCAITE FERMI TO UGE CITY-OWNED REAL PROPERTY FOR LANDSCAPING PURPOSES (PORTI) N OF NORTHWEST CORNER ATLANTIC AVENGE AND WEMSTER TREET) WHEREA,S, the City LS the umner of certain real property consistiaag of a strip of land 37 feet wide and 220 feet long, more or leoo, and being .17 acres, located at the northwest corner of Atlantic Avenue and Webster Street, more particularly shown and delineated on. the attached City Engineer's Map No. 3421-54; and EHEREAS, said property was acquired for street purposes frdm the state of California bmt iP not needed therefor 11 11. the Cityd by reason of increased traffic and othor considerations, adll be required to formulate plans for the re-alignment of the intersection of said Atlantic Avenue and Webster Street; and. WIERTME, it ip antirigated said. street use is sufficiently in the future so as to justify inclusion of the property- in the general landscaping plan proposed by the Peralta Junior College District for its Alameda Campus; and. WHEREAS, said District has requested 1156 of said property- for said purpose until street use thereof by the City becomes. necessary, and it would be in the b€' public imterest to devote the property- to the requested use; NOW THEREFORE, BE IT RESOLVED EY THE COUNCIL OF THE CITY OF ALAMEDA that the Peralta Munior College Diutrict be and hereby is granted a revocable permedt to use the City-owned real property shown on the attaelted City Engineer,s Map No. 3421-52 subject to each of the following terms ard conditions: (1) Said City '08 ,l Map is made a part of this permit for all purposes; (2) Stahl real propetty shall be used and devoted soielny to the Dietrict,s landscaping plan proposed for its Alameda Campus, provided however, that any ouch plan, to the extent it involves said propertyd shall be subject to the approval of the City, acting through its Director of Recreation and Parks; (E) No 1' o. struotures, pipes or installations of any kind shall be placed on, ovwr 02 Under said. property without kTitten authority- therefor first obtained. from City; (4) District shall save City free and harmless from, and at its own expence defend City against, any- claim, action or other proceeding against City by any person, arising out of the exercise by District of the rights granted herein; (o) This permit and all rights granted. thereby, shall be revocable by the City at any time after the expiration of six (8) months from the date hereof upon the adoption by thiF Council of a resolution determining said property- i3 required for street purposes. it may be cancelled at any- time h, mutual consent of District Citym Revocation by City, as aforesaid, shall be effective thirty (TO) days after wzMtten notice thereof to District; (6) if this Council should be resolution find and determine said property is not needed for street or other municipal. purposes, and if thereupon City desires to 11 0' of it, City shall give District the right of first refusal to p=anase same. the undersigned, hereby certify that tre foregoing Resamutor was duRT and regularly introduced and adopted by the Counell of the City of Alameda in regular meeting assembled on the 9th di oD March, 1960, by the fulfrowing vote, to wit.: AYES: Councilmen Liamtsey, Fere, La Croix, Jr., Levy and President McCall, (a).
