CALIFORNIA
WHEREAS, it was provided. in. the proceedings for the creatdon and consummation of Assessment
District No. 66-a City of Alameda, Alameda County, California, that any surplus remainEng in the
improvement fund after the Laprovemente were completed was to be credited pro rata, to each assesusnt
levied, in accordance 011 01 the provisions of ths Municipal improvement Act of 1913 and the Streets
and highways Code of the State of California; and
WHEREAS, Section 10427.1 of the Otheets and Highways Cods of the State of California
(being a portion of the Municipal improvement Act of 1915), under which saMi proceedings were taken,
provides that the surplus shall be refunded or credited pro rata to the parties assessed as follows:
(a) Where an 1111 0" assessment, or any installment of the principal thereof, has been
paid in cash, the credit shall be returned in cash to the perm= or persons paying the same upon
their furnishing satisfactory. evidence of payment;
(b) Where all or any part of an individual assessment remains unpaid, if said inaPvidual
assessment is not payable in installments, the credit. shall be applied in its entirety ubon such
individual assessment;
(c) Where all or any part of' an individual assessment remains unpaid and is payable in
installments, the credat shall be pro rated by dividing said credit by the number of principal in:tall-
ments remaining unpaid upon said individual assessment and a portion of such credit so pro rated shall
be applied against any principal and interest installments thereafter due in the rear such credit is
ordered and in each year thereafter; and
WHEREAS, the improvements have been ccupleted and the City Engineer of the City of Alameda
has filed a Final Recapitulation '0 Costs for said Assessment Distrint No. 66-1; and
REEREAS, there is a surplus in said fund for the improvements;
NOW, =EUROPE, BE IT RESOIBED BY the City Council of the City of Alameda, Alareda County,
California, as follows:
1. dhe =mai Recapitulation of Costs of the Gity Engineer of the City of Alameda, is hereby
approved and adopted as the final recapitulation of the costs of the bnprovements to be made in
Assessment District No. 66-2, City of Alameda, Alameda. County, California, and. all payments et to be
made shall be made in accordance thermUtbi;
2. dhere is hereby found to be a surplus in said improvement fund in the amount of
$23,538.51, whith said surplus im found by reference to tee costs provided in the estimate and the
amounts expended to date, as shown on the Final. Recapitulation of Costs attached hereto as falliblit
which said "Exhibit AB is, by this reference, incorporated herein and. made a part hereof;
3. The funds hereby declared to be surplus shall be transferred, to the Bond Redemption
Fund of Assessment 011'r '1, No. nk5-1, for the purnose of crediting the assessments or making the
refunds as hereinabove outlined; and.
4_ The Ire:ism:yr uf the City' of Alameda is hereby direoted to distribute the surplus from
the Bond Redemption Fund of Assessment District No. 66-1, iv the amount. of $23,538.31, in cash refund
or credit upon assessments in accordance with the provisions of Section 10427.1 of the Streets and
Highways (lode of the State of California.
