WHEREAS, it was provided in the proceedings for the creation and consummation of Assessment
District No. 6T-1, City of Alameda, Alameda County, '1 '1, that any surplus remaining in the
improvement fund after the improvements were completed. was to be credited pro rata to eanh assess-
ment ledied, in accordance with the provieions of the Municipal Improvement Act of 191.3; and the
Streets and Righwayo Code of tne State of California; and
WREREAS, Section 1042).1 of the Streets and Ilighwaccs Code of the State of California (being
a portion of the Municipal Improvement Aot of 1913), under which said proceedings were taken, pro-
vddds that the surplus shall be refunded or credited pro rata to the parties assessed as follows:
(a) landre an individual assessment, or any installment of the principal thereof, has
been paid in cash, the credit shall be returned in cash to the person or persons paying the cage
upon the furnishing satisfactory evidence of payment;
() Where all or any- part of an individual assessment remains unpaid, if said individual
assessment in not payable in installgdnto, the credit shall be applied dm its entirety upon. such
individual assessment;
(c) Where all or any part of an individual assessment remains unpaid and is payable in
installments, the credit shall be pre rated by dividing said credit by the number of principal.

rated shall. be applied against any principal a3 d. interest installments thereafter due in the year
such credit is ordered and in eaoh year thereafter; and
WHEREAS, the improvements have been completed and the City; Engineer of the City of Alageda
haa filed a Final Recapitulation of Costs for said Assessment Distrixt No. 6)-1, City; of Alameda,
Alameda 111 California; and
WHEREAS, tnere is a surplus in said fund for the improvements;
NOW, THEREFORE, BE IT RESOLVED 01 the City Council of the City; of Alameda, Alameda County,
California, as follows:
1. The Final Recapitulation 01 1 osts is hereby; approved and adRpted. as the final recapi-
tulation of the costs of Improvements in Assessment District No. 67-i, and all payments yet to be
made shall be made in accordance therewith.;
2. There is hereby found to be a surplus in said Improvement; fund In the amount of
addlln said surplus is found by reference to the costs provided. in the estimate and
amounts expended to date, as shown on the Final Recapitulation of Costs attached hereto as Exhibit A,
whrUch said Fandbit A is, by this reference, incorporated herein and made a part hereof;
3. The fund hereby declared to be surplus shall be transferred to the Bond Redemption
Fund of' Assessment District No. OV-1, City of Alameda, Alameda County, California, fcr the purpose
ef crediting the assessments or making the refunds as hereinabove outlined; and
As The City 3.-' ('(1.' of the City of Alameda. is hereby directed to distribute the surplus
from the Bond Redemption Fund of Assessmdnt District No. 67-1, in the amount of $2,699.92, in cash
refund or credit upon assessments in accordance wIth the provisions of Sanitin 101:2Nll of the Streets
and Highways Code of the State of California.
