FAITHFUL YERFORMANCE LOAD AS TO SUFFICIENCY (NORTHEAST OF
SNORE IJNE RRIVE AND WESTLINE DRIVE -- 11CM FILINIFK)
WHEREAS, pursuant to Section 11-319.1 of the Alameda Municipal Code, there has been pre-
sented to this Council a Parcel Map, designated Parcel Map No. 396, and heretofore conditionally
approved by the Planning Board, being a. division of the property located northeast of Shore tine
Drive and Westline Drive, in the City of Alameda, by- jack Filinick; ang
WHEREAS, said approval by the Planning Board is conditioned upon the execution by sub-
divider of an agreament to construct, and complete certain public improvements on said propertyj and.
WHEREAS, said subdivider has entered into such an agreement and has posted, his bond guar-
anteeing full, and faithful performance of said mbrk, ail. in accordance with said section; and
WHEREAS, it mill be to the benefit of the City to have said work performed in accordance
therewith;
OW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF Tial CITY OF ALUMI5 that the agremnent
for the construction and completion of the improvements in the division of property- located north-
east, of Shore Line Drive and Westline Drive; designatod as Parcel. Map No. 396, by Jack Filinick, be,
and the same hereby la, approved, and the City Manager ia authoriged and ddrected to execute, and
the City Clerk to attest, maid agreement on behalf of the Cityd and
BE IT FOR TIER RESOLVED that the bond in the sum of $124,400.00, guarantoeing full. and
faithful performance of said contract, is hereby approved as 're in amount.
I, the undersigned, hereby certify that the foregoing Resolution waa duly. and regularly
introduced and adopted by the Council of the City of Alameda in adjourned regular meeting assembled
