VOIFFIAS, it was provided in the proceedings for the creation and consummation of Assessment
District No. 6E-1, City of Alameda, Alameda. County, CalifPrnia, that any surplus remaining in the
Improvement fund after the improvements were completed was to be credited pro rata tE each aEsessment
levied, in accordance with the provisions of the Municipal improvement Act of 1.91E and the Streets
and Highways Code of the State of California; and
WHEREAS, Section 10427.1 of the Streets and. nghways Code of the State of Galifornda
(being a portion of the Municipal_ improvement Act of a.,;a3), under which saiel proceedings were taken,
provides that the surplus shall be refunded or credited pro rata to the parties assessed as follows:
(a) Where an individual assessment, or any installment of the principal thereof, has been.
paid Ln cash, the credit shall be returned in cash to the person or persons paying the same upon
their furnishing satisfactory evidence of payment;
(b) Where all or any part of an individual assessment remains unpaid, if said individual
assessment is not payable in installments, the credit shall be applied in its entirety upon such
indiyidual assessment;
(c) Where all or any part of an individual assessment remains unpaid and is payable in
installments, the credit shall be pro rated by dividing said credit by the number of principal ibbtaldp
ments reaaining unpaid upon said individual assessment and a portion. of such credit so pro rated. shall
be applied against any. princigal and interest installments thereafter due in tRe year such ontdit is
ordered and in each year thereafter; and_
WhEREAS, the improvements have been completed and the City Engineer of the City cf Alameda
has filed an Amended Final Recapitulation of Costs for sada Assessment District No. 6E-1, City of
Alameda, Alameda. County, California, and
WHEREAS, there is a surplus in said fund. for the improvements;
NOW, ThREFFORR, BF IT RESOLVED by- the City Council of the City of Alameda, Alameda County,
California, a.3 follows:
The Amended Final Rs:capitulation of Costs is hereby approved and adopted as the 1,11, o'
fina5 recapitulation of the costs of improvements in Assessment District No. 67-1, and all_ payments
yet to be made shall be made in acceNdance therewith;

$3,609.92, which said surplus le found by reference to the costs provided in the estimate and aneunts
