AUTHORIZING ERECUTION OF' AGREEMENT FOP CONSTRUCTION AND
COMPLEVION OM IMPROVEMENTS IN CONNECTION WITH PARCEL MAP
NO. 444 AND LOPROVING CASH DEPOSIT AS TO SUFFICIENCY IN
LIEU OF SURETY PERFORMANCE POND (1446 WEESTER STEISET, -
PPOWN GARIGUYLK AND KRANTZ:NAN)
WHEREAS,
3' 1't te Section 11-RIE.1 of the Alameda Municipal Code, there has been pre-
sented to this Council a Parcel Map, designated Parcel. Map No. 444, and heretofore condonally
approved by the Planning Board, being a divlsion of the property- located at lAKS. Webster Street,
in the City of Alameda, by Max M. ErcAn, Sam Garfinkle, and Irving Krantzman; and
WHEREAS, said approval by the Planning Board is conditioned upon the executien by
subdividers of an agreement to construct and complate certain public improvements on said property;
and
AEEREAS, said subdividers have entered into such_ agreement and have posted. and deposited
in lieu of a :surety performance bond a cash bond in the cum of' $1,00.00 guaranteeing full_ and
faithful performance of said Perk, all in accordance with said section; and
WHEREAS, it will be to the benefit, of the City to have said 014' performed in accordance
therewith;
NOW, THEREFORE, BE IT RESOLVED BY TEE GORECKI OF TEE crry OF ALAMEDA that tho agreement
for the construction and completion of the imprownnents in the division of property located at
1446 Webster Street, designated as Parcel Map FM. 444, by Max M. Brown, Sam Garfinkle and Irving
rantzman, be, and the same hereby is, approved, and the City Manager is authorized and directed
to execute, and the City Clerk to attest, said agreement on behalf of the City; and
RE IT FURTHER RESOLVED that said cash bond, in lieu of a performance bond, is hereby-
approved as sufficient in amount.
