CANCEMEING AWARD OE' CONTRACa! FOR CONSURTOTIEN OF STORM SEWER
INTERCONNECTION ON WE:PETER STREET NEAR 17,11AE AVENUE (SFECIF1.-
CATIONS PW 8-( 9-16; BEFOG, INC.)
WHEREAS, pursuant to Resolution No. 7522, adopted August 161, 1969, the City adopted Speci-
fications, Special Provisions and Plans for the construction of a storm sewer interconnection on
Webster Street near Tynan (11 e. numbered PW 8-69-16, called, for bias thereon and authorized advertising
thereof; and
NREREAS, in response thereto 13p(°, Inc. , a California corporatimn, duly submitted its proposal
to perform said public work which proposal was on, September 11, 1969, accepted by this Council, and a
minute order made awarding the contract therefor to said bidder; and
NnEREAS, it appeared unusual underaTound condatione, consisting of a. former street, of Kwelve-
inch thick concrete, existed in the area proposed for said work which if known to all the bidders would
have substantially changed their proposals, and whim:El condktion may have been known to the City; and
WNEREAS, the City Engineer now recommends the said award be rescinded and that the said storm
sewer be redesigned and relocate d. to avoid. said underground conditions, and Ms is in the public interest,
to do so;
NOW MEREFORE BE IT RESOLVED EY 1111: COUNCIL Of' THE CITY OF ALAKEDA that the award of contract
to Eepco, Inc., ih. accordance with the Specifications hereihatove referred to, be and the same hereby
is cancelled and. rescinded.
