ORDERING VACATION OF PORTION OF PUBLIC UTILITY EASEMENT
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that a certain portion of the public
utility easement lying within the southwesterly portion of Block 4, Tract 3105, as said easement and
block are shown on that certain map entitled, "Tract 3105, Ballena Bay Community, Alameda, California,"
being more particularly described as follows:
COMMENCING at the City Survey Monument having coordinates Y = 467,464.75 feet and X = 1,484,131.475
feet based on the California Coordinate System, Zone III, as are all bearings and distances
in this description, said monument being in the westerly portion of Private Roadway "A" and
P.U.E. (Public Utilities Easement) as said Monument, Roadway and P.U.E. are shown upon that
certain map entitled, "TRACT 3105, BALLENA BAY COMMUNITY, ALAMEDA, CALIFORNIA," filed
February 26, 1970 in Book 63 of Maps at pages 79 through 82, inclusive, Alameda County
Records;
THENCE N. 01°0540" E. 5.00 feet to the southwesterly corner of Block 4 of said Tract 3105, said
corner being upon the easterly line of Ballena Boulevard as shown upon the map of said Tract;
THENCE along said easterly line N. 03 00519" E. 53.00 feet to the TRUE POINT OF BEGINNING of this
description;
THENCE continuing along said easterly line N. 03°0519" E. 19.00 feet to the northwesterly corner
of the 15 foot strip of said Roadway 'A" and P.U.E.;
THENCE along the northerly line of said 15 foot strip S. 86°5441" E. 15.00 feet;
THENCE along the easterly line of said strip S. 03°1519" W. 51.705 feet to a point upon the
northerly line of the 40 foot strip of said Roadway and P.U.E.;
THENCE westerly along the arc of a curve concave southerly hving a radius of 515 feet (a radial
lip of said curve through last said point bears N. 02 5028" E.) through a central angle of
DO 2002" for an arc distance of 3.00 feet;
THENCE N. 03°0519" E. 32.73 feet;
THENCE N. 86°5441" W. 12.00 feet to the TRUE POINT OF BEGINNING,
is hereby ordered vacated pursuant to the provisions of Section 50443 of the Government Code of he
State of California.
BE IT FURTHER RESOLVED that the Council of the City of Alameda hereby finds and declares
that (1) the said portion of easement ordered vacated herein is unnecessary for present or prospective
public use, and (2) that said portion of said easement has never been used by the City of Alameda for
any purpose whatever since February 26, 1970, the date of its acceptance by the City, to the date of
this resolution.

20th day of October, 1970, by the following vote, to wit:
