GRANTING FIORE MARCHESCHI REVOCABLE FENCE ENCROACHMENT
PERMIT (1118 SAN ANTONIO AVENUE)
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that there is hereby granted to Fiore
Marcheschi, owner of premises at 1118 San Antonio Avenue, e permit, revocable at the sole discretion of
this Council, to maintain a solid fence adjoining said property, and located approximately 100 feet west
of Bay Street on south side of San Antonio Avenue, which encroaches ten inches (10") into City property.
Said revocable permission is granted, and accepted by permittee, upon each of the following conditions:
(1) Permittee shall maintain and keep in good repair said solid fence at his sole cost, at
its present location as installed in connection with Parcel Map 520;
(2) By acceptance of this permit, Fiore Marcheschi and his assigns and representatives agree
to hold the City harmless from any and all liability and claims of whatever nature, arising out of the
construction, maintenance or use of said encroachment, or from the exercise of this permit;
(3) Permittee shall obtain and keep in full force a policy of insurance, in form approved by
the City Attorney, indemnifying, insuring and holding harmless the City of Alameda from all claims,
liability, causes of action and litigation occurring or arising by reason of the existence of said fence,
said policy to name the City of Alameda as an additional insured.
(4) Permittee shall remove said fence upon demand by the City Council, or upon a finding by
said Council the encroachment upon City property interferes with the public health, welfare or safety.

I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted by the Council of the City of Alameda in regular meeting assembled en the
2nd day of March, 1971, by the following vote, to wit:
AYES: Councilmen Fore, Levy, Longaker, McCall and President Le Croix, Jr., (5).
NOES: None,
ABSENT: None.
