GRANTING MARTIN D. DURANTE REVOCABLE FENCE ENCROACHMENT
PERMIT SUBJECT TO PLANNING DEPARTMENT APPROVAL (1010
SHERMAN STREET)
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that there is hereby conditionally
granted to Martin D. Durante, owner of premises known as 1010 Sherman Street, a permit, revocable at
the sole discretion of this Council, to construct a brick and iron fence which encroaches not more than
one foot, two inches (1'2"), overall, on City property along the easterly line of Sherman Street abutting
permittee's said property for a distance of 127 feet, all in strict accordance with the requirements of
the City Engineer.
BE IT FURTHER RESOLVED that said permit is granted, and accepted by permittee, upon each of
the following conditions:
(1) The height of said fence and of any other fence located on permittee's property
shall comply with the City's zoning regulations, specifically Section 11-144 7 (j),
Alameda Municipal Code, unless, prior to construction, permittee shall first obtain
the written approval of the Planning Department to construct same to a greater
height;
(2) Permittee shall pay all costs of construction of said encroaching fence, and all
costs required by reason of any termination of this permit;
(3) Construction, design, painting, precise location and all maintenance of said fence
shall be done by permittee to the satisfaction of the City Engineer;
(4) By acceptance of this permit, said Martin D. Durante and his assigns and representa-
tives agree to hold harmless the City from any and all liability and claims- of
whatever nature, arising out of the construction or use of said encroaching fence,
or from the exercise of the permit herein granted.

I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the
2nd day of March, 1971, by the following vote, to wit:
AYES: Councilmen Fore, Levy, Longaker, McCall and President La Croix, Jr., (5).
NOES: None.
ABSENT: None.
