Resolution 07754CITY OF ALAMEDA RESOLUTION NO. 7754 APPROVING FINAL MAP OF CONDOMINIUM SUBDIVISION KNOWN AS TRACT 3270, AUTHORIZING EXECUTION OF AGREEMENT FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS THEREIN, ACCEPTING CERTAIN EASEMENTS, AND APPROVING FAITHFUL PERFORMANCE BOND AS TO SUFFICIENCY (PORTOLA AVENUE AND NINTH STREET - LINDSEY, GALLAGHER & WILLETT, A PARTNERSHIP, SUBDIVIDERS) WkEREAS, there has been heretofore filed with and approved by this Council a Tentative Map of that certain proposed condominium subdivision known as Tract 3270; and WHEREAS, pursuant to Article 1, Chapter 3, Title XI of the Alameda Municipal Code, Lindsey, Gallagher & Willett, a partnership comprised of Donald W. Lindsey, Jack F. Gallagher and Wilbur L. Willett, Subdividers herein, have presented to this Council a Final Nap of the said condominium subdivision known as Tract 3270; and WHEREAS, said subdividers have entered into an agreement with the City to construct and complete the public improvements in said subdivision and to post with the City Clerk their bond in the amount of $10,200.00 to guarantee full and faithful performance of said work, all in accordance with said Article; and WHEREAS, said Final Map delineates thereon certain easements dedicated for public use; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the Final Map of Tract 3270, be and hereby is approved. BE IT FURTHER RESOLVED that the agreement for construction and completion of the public improve- ments in said subdivision, and all its terms and conditions, be and hereby is approved, and the City Manager and the City Clerk are authorized and directed to execute and attest to, respectively, said agree- ment on behalf of the City. BE IT FURTHER RESOLVED that said easements dedicated for public use are hereby accepted, on behalf of the public, in conformity with the terms of the offer of dedication. BE IT FURTHER RESOLVED that the bond in the sum of $10,200.00, guaranteeing full and faithful performance of the subdividers said public improvements construction contract, is hereby approved as sufficient in amount. * * * * * * * * * * 1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 16th day of March, 1971, by the following vote, to wit: AYES: Councilmen Fore, Levy, Longaker, McCall and President La Croix, Jr., (5).
