Resolution 07756180 CITY OF ALAMEDA RESOLUTION NO. 7756 ORDERING VACATION OF PORTION OF PUBLIC UTILITY EASEMENT (SOUTHERLY THREE-FEET OF TRACT 3271) WHEREAS, by its Resolution No. 7750, regularly adopted March 16, 1971, this Council declared its intention to vacate a portion of that certain public utility easement hereinafter more particularly described, all in accordance with provisions of the state Public Easements Vacation Law, and thereafter caused publication of said Resolution and posting of notices of said intended vacation as required by said Law, both said Resolution and notices fixing the time and place for hearing all persons interested in the vacation as Tuesday, April 6, 1971, at 7:30 o'clock p.m., in the Council Chamber, City Hall, Alameda, California; and WHEREAS, at said time and place the matter of the proposed vacation came on regularly for hearing by this Council at its regular meeting, and proof of publication of said Resolution and of posting of said notices in the manner required by law having been made by the City Clerk, and the Council then having heard all the evidence, both oral and documentary, proferred by all persons interested in said matter, and the Council being fully advised in the premises and the matter thereupon submitted for determination; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA: (1) It is hereby found and determined that the portion of the public utility easement in said Resolution of Intention and hereinafter particularly described is unnecessary for present or pros- pective public use, and the public interest requires vacation of same; (2) It is hereby ordered that the following public utility easement be, and it is, vacated: Being a three-foot wide strip along the southerly property line of Tract 3271, more parti- cularly described as: In the southwesterly portion of Lot 2, Property Division Map 153, Alameda, California. COMMENCING at the monument having coordinates Y=463,803.79 feet and X=1,493,280.68 feet, based on the California Coordinate System, Zone III, as are all bearings and distances in this description, said monument being at the intersection of the monument lines of Otis Drive (84 ft. wide) and Willow Street (60 ft. wide) as said monument, Drive, and Street are shown upon that certain map entitled, "PROPERTY DIVISION MAP 153, ALAMEDA, CALIFORNIA" filed for record September 10, 1965 in Book 47 of Maps at page 60, County of Alameda Records; THENCE along said monument line of Otis Drive N. 63°4858" W. 42.94 feet; THENCE S. 26°1102" W. 32.00 feet to the most northerly corner of Lot 2 of said Property Division Map 153; THENCE along the northwesterly line of said lot S. 29°12'03" W. 186.80 feet to the most westerly corner thereof; THENCE along the southwesterly line of said lot S. 55°1319" E. 11.07 feet to the TRUE POINT OF BEGINNING; THENCE N. 29°1203" E. 3.01 feet; THENCE S. 55°1319" E. 75.57 feet to the southeasterly line of said Lot 2; THENCE along said southeasterly line S. 34°4641" W. 3.00 feet to the most southerly corner thereof; THENCE along the southwesterly line of said Lot 2 N. 55°1319 W. 75.28 feet to the TRUE POINT OF BEGINNING. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 6th day of April, 1971, by the following vote, to wit: AYES: Councilmen Fore, Levy, McCall and President La Croix, Jr., (4).
