CITY OF ALAMEDA RESOLUTION NO 7778
GRANTING STEPHEN M. RICE REVOCABLE SIDEWALK ENCROACHMENT
PERMIT ("THE FRONT ROOM," 1821 WEBSTER STREET, 7 BY 32 INCHES)
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that, pursuant to Section 5-264.1,
Alameda Municipal Code, Stephen M. Rice, a general partner in, and acting for The Front Room,"
1821 Webster Street, is hereby granted a permit, revocable at the sole discretion of this Council,
to maintain two non-bearing, architectural pillars, on the sidewalk in front of said establishment
which encroach seven inches, for a lateral distance of thirty-two inches each, into the public right
of way, subject to each of the following conditions:
(1) Permittee, Stephen M. Rice, his assigns and representatives, by acceptance of this
permit, agrees to hold the City harmless from any and all liability, claims, or actions of whatever
nature, arising out of the construction, maintenance or use of said encroachment, or from the exercise
of this permit;
(2) This permit shall not become effective until Pernittee shall obtain, and thereafter
keep in full force and effect, a policy of insurance, in form approved by the City Attorney, indemnifying,
insuring and holding harmless the City of Alameda, and its officers, agents and employees from all
liability and claims occurring or arising by reason of the existence of said encroachment, said policy
to name the City of Alameda, its officers, agents and employees, as additional insureds;
(3) Permittee agrees to and shall remove said encroachment upon demand by the City Council,
or upon a finding by said Council the encroachment upon City property interferes with the public health,
welfare or safety.

I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the
18th day of May, 1971, by the following vote, to wit:
AYES: Councilmen Fore, Levy, Longaker, McCall and President La Croix, Jr., (5).
NOES: None.
ABSENT: None.
