Resolution 07845288 CITY OF ALAMEDA RESOLUTION NO. 7845 OVERRULING OBJECTIONS TO NOTICE TO PERFORM WORK IN SANTA CLARA AVENUE--THIRD STREET--LINCOLN AVENUE STREET LIGHTING IMPROVEMENT DISTRICT AND AUTHORIZING SUPERINTENDENT OF STREETS TO CAUSE SAID WORK TO BE PERFORMED WHEREAS, a petition signed by owners of more than sixty percent (605) of the front footage of property facing Santa Clara Avenue between Lincoln Avenue and Third Street, the next intersecting streets (said property being a 'block", as defined in Sections 5870 and following, Streets and Highways Code of California), has been filed with the City Clerk requesting the installation of street lighting facilities in front of said property; and WHEREAS, on September 24, 1971, in accordance with the provisions of Div. 7, Pt. 3, Ch. 27 of said Code, and pursuant to Section 5876 thereof, the Superintendent of Streets has duly notified the owners of said property to instal said street lighting facilities; and WHEREAS, said Notice required said owners to complete installation of said facilities within sixty days thereafter, the work to consist of installing mercury vapor luminaires with six foot long steel supporting arms and brackets on existing wood power poles located along the street at intervals of approximately 115 feet, and to do the necessary electrical wiring all in accordance with City of Alameda standards; and WHEREAS, said Notice specified Tuesday, October 5, 1971, at 7:30 p.m., in the City Council Chamber, located in the City Hall, as the time and place when the City Council will her and pass upon objections or protests, if any, which may be raised by any said property owner or other interested persons to said work of installation of said street lighting facilities; and WHEREAS, the hearing of said matter having regularly come before this Council at the time and place so noticed, and the Council having heard and passed upon all such objections or protests and being fully advised in the premises, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that it is hereby found, determined and decided that all objections or protests (there being none) to said Notice or to any matters contained therein, are hereby overruled, and the said Superintendent of Streets be and he hereby is authorized to cause to be performed the installation of street lighting facilities described in said Notice, all in accordance with the provisions of said Div. 7, Pt. 3, Ch. 27, of said Streets and Highways Code of California; BE IT FURTHER RESOLVED that the property affected by said work be designated as the "Santa Clara Avenue--Third Street--Lincoln Avenue Street Lighting Improvement District." * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 5th day of October, 1971, by the following vote, to wit: AYES: Councilmen Fore, Levy, Longaker, McCall and President Le Croix, Jr., (5).
