Resolution 07876316 CITY OF ALAMEDA RESOLUTION NC. 7876 DECLARING INTENTION TO VACATE PORTIONS OF A SANITARY SEWER EASEMENT AND A STORM SEWER EASEMENT, FIXING DATE FOR HEARING THEREON, AND ORDERING PUBLICATION AND POSTING OF NOTICE (IN TRACT 3270, PORTOLA AVENUE-NINTH STREET) BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that, pursuant to the Public Service Easements Vacation Law (Secs. 50430 and following, Government Code of California), and upon the sub- mission to and action by the Planning Board of said matter, the public interest requires, and said Council hereby declares its intention to order, the vacation of two public service easements in the City of Alameda, being a portion of a sanitary sewer easement, and a portion of a storm sewer ease- ment located within that certain subdivision known as Tract 3270 and as shown on the City Engineer's Drawing No. 6666, Case 54, which said document is on file in the office of the City Engineer, more particularly described as follows: PARCEL 1 A parcel of land situated in the City of Alameda, County of Alameda, State of California, described as follows: A portion of that certain easement for storm water drainage purposes designated as Parcel "A" in Resolution No. 5849 of the City of Alameda, a certified copy of which was recorded April 16, 1959, in Book 8995 of Official Records at Pages 577 through 580, County of Alameda Records, more parti- cularly described as follows: COMMENCING at the United States Coast and Geodetic Survey Monument "NINTH" having coordinates Y , 466,852.90 feet :and Xi '1,488;604.21 feat, based :on the California Coordinate System, lonaLLTas are all'beerings and distances in this description, said monument being on the westerly side of Ninth Street southerly of San Antonio Avenue, as said monument, Street and Avenue are shown upon that certain map entitled, "TRACT 1898, SOUTH SHORE UNIT NO. 2, ALAMEDA, CALIFORNIA", filed August 22, 1958, in Book 38 of Maps at pages 89 through 92, County of Alameda Records; THENCE South 09° 57' 37" East 40.47 feet to the point of intersection of the centerline of said Parcel "A" with the southerly line of Ninth Street as said street now exists; THENCE South 87° 10' 05" East 5.00 feet; THENCE South 02° 49 55" West 4.00 feet to the TRUE POINT OF BEGINNING; THENCE South 02° 49' 55" West 18.98 feet; THENCE South 33° 10' 05" East 17.99 feet to the northwesterly boundary of Parcel "C" as said parcel is designated in said Resolution No, 5849; THENCE South 40° 42' 59" West, along the northwesterly boundary of said Parcel "C", 10.41 feet; THENCE North 33° 10' 05" West 24.13 feet; THENCE North 02° 49' 55" East 22.22 feet; THENCE South 87° 10' 05" East 10.00 feet to the TRUE POINT OF BEGINNING. PARCEL 2 A parcel of land situated in the City of Alameda, County of Alameda, State of California, described as follows: A portion of that certain, easement for sanitary sewer purposes described in the Resolution and Grant of Easement recorded April 22, 1955, in Book 7637 of Official Records at Pages 319 through 321, County of Alameda Records, more particularly described as follows: COMMENCING at the United States Coast and Geodetic Survey Monument, "NINTH", having coordinates Y = 466,852.90 feet, and X = 1,488,504.31 feet, based on the California Coordinate System, Zone 3, as are all bearings and distances in this description, said monument being on the westerly side of Ninth Street southerly of San Antonio Avenue, as said monument, Street and Avenue are shown upon that certain map entitled, "TRACT 1898, SOUTH SHORE UNIT NO. 2, ALAMEDA, CALIFORNIA", filed August 22, 1958 in Book 38 of Maps at pages 89 through 92, County of Alameda Records; THENCE South 15° 08' 15" West 139.80 feet to the TRUE POINT OF BEGINNING, said point being on the northeasterly line of the aforesaid easement; THENCE South 40° 42' 59" West 10.22 feet to the southwesterly line of said easement; THENCE along said southwesterly line North 61° 14' 08" West 18.33 feet; THENCE North 49° 17' 01" West 16.92 feet; THENCE South 40° 42' 59" West 3.50 feet; 317 THENCE North 49° 17 01° West 20.94 feet; THENCE North 40° 42' 59" East 5.71 feet to the aforesaid northeasterly line of said easement; THENCE along said northeasterly line South 61° 14' 08" East 57.03 feet to the TRUE POINT OF BEGINNING. BE IT FURTHER RESOLVED that the time and place hereby fixed for hearing all persons interested in the proposed vacation is: Tuesday, February 15, 1972 7:30 o'clock p.m., Council Chamber, City Hall, Alameda, California, BE IT FURTHER RESOLVED that the City Clerk is hereby directed to publish a copy of this resolution twice, once in each of two successive weeks prior to said hearing, in the official newspaper of the City of Alameda, and to cause to be posted notices of said proposed easement vacation in the manner prescribed by Section 50441 of said Code. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 18th day of January, 1972, by the following vote, to wit: AYES: Councilmen Fore, Levy, Longaker, McCall and President La Croix, Jr., (5).
