Resolution 07882:325 CITY OF ALAMEDA RESOLUTION NO. 7882 ORDERING VACATION OF PORTIONS OF PUBLIC SERVICE EASEMENTS (IN TRACT 3270, PORTOLA AVENUE-NINTH STREET) WHEREAS, by its Resolution No. 7876, regularly adopted January 18, 1972, this Council declared its intention to vacate portions of two public service easements hereinafter more particularly described, all in accordance with provisions of the state Public Easements Vacation Law, and thereafter caused publication of said Resolution and posting of notices of said intended vacation as required by said Law, both said Resolution and notices fixing the time and place for hearing all persons interested in the vacation as Tuesday, February 15, 1972, at 7:30 o'clock p.m., in the Council Chamber, City Hall, Alameda, California; and WHEREAS, at said time and place the matter of the proposed vacations came on regularly for hearing by this Council at its regular meeting, and proof of publication of said Resolution and of posting of said notices in the manner required by law having been made by the City Clerk, and the Council then having heard all the evidence, both oral and documentary, proferred by all persons interested in said matter, and the Council being fully advised in the premises and the matter thereupon submitted for determination; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA: (1) It is hereby found and determined that the portions of the public service easements in said Resolution of Intention and hereinafter particularly described are unnecessary for present or prospective public use, and the public interest requires vacation of same; (2) It is hereby ordered that the following public service easements be, and they are, vacated: PARCEL 1 A parcel of land situated in the City of Alameda, County of Alameda, State of California, described as follows: A portion of that certain easement for storm water drainage purposes designated as Parcel "A" in Resolution No. 5849 of the City of Alameda, a certified copy of which was recorded April 16, 1959, in Book 8995 of Official Records at Pages 577 through 580, County of Alameda Records, more particularly described as follows: COMMENCING et the United States Coast and Geodetic Survey Monument "NINTH" having coordinates Y = 466,852.90 feet and X = 1,488,504.31 feet, based on the California Coordinate System, Zone 3, as are all bearings and distances in this description, said monument being on the westerly side of Ninth Street southerly of San Antonio Avenue, as said monument, Street and Avenue are shown upon that certain map entitled, "TRACT 1898, SOUTH SHORE UNIT NO. 2, ALAMEDA, CALIFORNIA", filed August 22, 1958, in Book 38 of Maps at pages 89 through 92, County of Alameda Records; THENCE South 09° 57' 37" East 40.47 feet to the point of intersection of the centerline of said Parcel "A" with the southerly line of Ninth Street as said street now exists; THENCE South 87° 10' 05" East 5.00 feet; THENCE South 02° 49' 55" West 4.00 feet to the TRUE POINT OF BEGINNING; THENCE South 02° 49' 55" West 18.98 feet; THENCE South 33° 10' 05" East 17.99 feet to the northwesterly boundary of Parcel "C" as said parcel is designated in said Resolution No. 5849; THENCE South 40° 42 59' West, along the northwesterly boundary of said Parcel "0", 10.41 feet; THENCE North 33° 10' 05" West 24.13 feet; THENCE North 02° 49' 55" East 22.22 feat; THENCEISouth 87° 10' 05" East 10.00 feet to the TRUE POINT OF BEGINNING, PARCEL 2 A parcel of land situated in the City of Alameda, County of Alameda, State of California, described as follows: A portion of that certain easement for sanitary sewer purposes described in the Resolution and Grant of Easement recorded April 22, 1955, in Book 7537 of Official Records at Pages 319 through 321, County of Alameda Records, more particularly described as follows: COMMENCING at the United States Coast and Geodetic Survey Monument, "NINTH", having coordinates Y = 466,852.90 feet, and X - 1,488,504.31 feet, based on the California Coordinate System, Zone 3, as are all bearings and distances in this description, said monument being on the westerly side of Ninth Street southerly of San Antonio Avenue, as said monument, Street and Avenue are shown upon that certain map entitled, "TRACT 1898, SOUTH SHORE UNIT NO. 2, ALAMEDA, CALIFORNIA", filed August 22, 1958 in Book 38 of Maps at pages 89 through 92, County of Alameda Records; f39 THENCE South 15° 08 15" West 139.80 feet to the TRUE POINT OF BEGINNING, said point being on the northeasterly line of the aforesaid easement; THENCE South 40° 42' 59" West 10.22 feet to the southwesterly line of said easement; THENCE along said southwesterly line North 61° 14' 08" West 18.33 feet; THENCE North 49° 17' 01" West 16.92 feet; THENCE South 40° 42' 59' West 3.50 feet; THENCE North 49° 17' 01" West 20.94 feet; THENCE North 40° 42' 59" East 5.71 feet to the aforesaid northeasterly line of said easement; THENCE along said northeasterly line South 61 0 14' 08" East 57.03 feet to the TRUE POINT OF BEGINNING. ********** I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by tfte Council of the City of Alameda in regular meeting assembled on the 15th day of February, 1972, by the following vote, to wit: AYES: Councilmen Fore, Levy, Longaker, McCall and President La Croix, Jr., (5).
