Resolution 07895CITY OF ALAMEDA RESOLUTION NO. 7895 GRANTING REVOCABLE PERMIT TO CONSTRUCT PEDESTRIAN BRIDGE CROSSING SHOREPDINT COURT WHEREAS, the City Planning Board on January 25, 1971, approved the Planned Development application of Doric Development, Inc., for the "South Shore Beach and Tennis Club," loeated at Shore- point Court and Westline Drive, in accordance with conditions imposed upon construction thereof by said Board; and WHEREAS, in connection with said development it is desirable that foot traffic at grade across Shorepoint Court, which divides the club project, be reduced or eliminated by construction of a pedestrian overpass or bridge over said street, NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that a permit, revocable at the sole option of this Council, be and hereby is granted to Doric Development, Inc., owner of the project above referred to, which is located in Subdivision Tract No. 3069, to construct and maintain a pedestrian bridge over and across Shorepoint Court at a point approximately 300 feet east of Westline Drive, subject to each and every of the following conditions: (1) The precise location and construction details thereof shall be as the City Engineer shall first approve; (2) The width thereof shall be 8 feet, and its height shall be at least 14 feet 6 inches minimum above the highest point of the street pavement, and supported by piers located in the parkway strips on either side of the paved portion of said street; (3) The center line of said piers shall be approximately 31-i feet inboard from the curbfaces of said street, and the total span length between center lines of said pier shall be 47 feet; (4) The stairway approaching the bridge from the north side shall begin from a raised embank- ment, and said stairway itself shall rise approximately 8 feet 9 inches; the stairway from the south side shall commence from the recreation complex and be served by elevator; (5) There shall be a hand railing along each side thereof not less than 3 feet 6 inches in height; (6) Street clearance of said overpass shall equal or exceed that required by the state Department of Motor Vehicles and the City Fire Chief; (7) Permittee shall acquire no interest whatever in real property of the City by the exercise of any right given hereby; (8) Building and other permits required by the City for construction shall first be obtained; (9) By acceptance of this permit, Doric Development, Inc., its assigns and successors, agree to hold the City harmless from any and all liability and claims of whatever nature, arising out of the construction, operation, maintenance or use of said pedestrian bridge; (10) Said Permittee shall obtain and keep in full force a policy or policies of insurance, in amounts and in form as the City Attorney shall first approve, indemnifying, insuring and holding harmless the City of Alameda, its officers, agents and employees, from all claims, liability, causes of action and litigation occurring or arising from the construction, operation, maintenance or use of said bridge, said policies to name the City of Alameda and its officers and employees as additional insureds. Said insurance coverage shall be obtained before Permittee commences construction and shall contain a 20-day notice of cancellation clause; (11) In the event said indemnification and insurance is cancelled, terminated or lapses, Permittee shall immediately cease further construction or prohibit use of said bridge, failing which the City may do so; (12) Permittee shall at all times control use of said private overpass to persons lawfully using its club facilities, and shall, if the City Engineer or the Chief of Police deems it necessary, install such screens, barriers or the like as will protect persons using the public street oelow; (13) Permittee shall at all times keep said bridge and its appurtenances in good repair and in a manner as will provide safe use to persons using same. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 21st day of March, 1972, by the following vote, to wit: AYES: Councilmen Fore, Levy, Longaker, McCall and President La Croix, Jr., (5).
