Resolution 08281CITY OF ALAMEDA RESOLUTION NO. 8281 DECLARING INTENTION OF COUNCIL TO ORDER VACATION OF PORTION OF THE NORTHERLY TERMINUS OF MARKET STREET, A PUBLIC STREET IN THE CITY OF ALAMEDA, REFERRING TO CERTAIN MAP FOR PARTICULARS THEREOF, FIXING TIME AND PLACE FOR HEARING THEREON, AND ORDERING PUBLICATION AND POSTING OF NOTICES OF SAID PROPOSED VACATION BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that it is the intention of this Council, in accordance with the provisions of the Street Vacation Act of 1941, to order the vacation of an unused portion cf a public street, being a 205(49 1/3 portion of the northerly terminus of Market Street, situated in the City of Alameda, County of Alameda. State of California, and more particularly described as follows: A portion of the northern terminus of Market Street, as shown on the "Map of Alameda', surveyed and drawn by J. T. Stratton, 1853; filed July 24, 1879 in Book 6 of Maps, page 1, in the Office of the Alameda County Recorder, and mere particularly described as follows: BEGINNING at the most eastern corner of the northeastern terminus of said Market Street, said point being the most northern corner of Lct 8, Block 63, as shown on said map; THENCE southwesterly along the southeastern line of said Market Street, 49-1/3 feet; THENCE northwesterly at right angles to last said lire, 20 feet; THENCE northeasterly and parallel with said southeastern line of Market Street, 49-1/3 feet, more or less, tc the northeastern terminus of said street; THENCE southeasterly along the line cf last said terminus, 20 feet, more or less, tc the BEGINNING. BE IT FURTHER RESOLVED that reference is hereby made for particulars of the proposed vacation to that certain map entitled, "Partial Abandonment Northerly Terminus Market Street," on file in the office of the City Clerk and being City Engineer's Drawing No. 7132, Case 52. BE IT FURTHER RESOLVED that said Council hereby finds and determines that public con- venience and necessity do not require reservation in the City of Alameda pursuant to Sections 8330 and 8331, Streets and Highways Code of California, of any easements or rights of way in the said portion of the street proposed to be vacated. BE IT FURTHER RESOLVED that all proceedings for the vacation herein proposed shall be in accordance with the provisions of Part 3 of Division 9, of the Streets and Highways Code of California, BE IT FURTHER RESOLVED that notice is hereby given that the 7th day of January, 1975, at 7:30 p.m. is hereby fixed as the time, and the Council Chambers in the City Hall, Alameda, California, as the place, for hearing all persons interested in or objecting to the herein proposed vacation. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause notices of the street vacation herein proposed to he posted conspicuously along the line of said street, at least ten (18) days before the date set for said hearing. Such notices shall be posted not more than 300 feet apart, but at least three (3) shall be posted, and such notices shall state the passage of this resolution of intention and the time and place of the hereinabove mentioned hearing, BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have this resolution published in the manner prescribed by Section 3-14 of the Charter of the City of Alameda for the publishing of ordinances. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 19th day of November, 1974, by the following vote, to wit: AYES: Councilmen Beckam, Corica, Hurwitz, McCall and President La Croix, jr., (5).
