CONSENT TO ASSIGNMENT OF LEASE TO JOHN BENTZEN, OF REAL PROPERTY
HELD UNDER LEASE BY AND BETWEEN THE CITY OF ALAMEDA AND SANTA FE-
POMEROY, INC. (3.501 ACRES LOCATED ON NORTHEAST LINE OF CLEMENT
AVENUE)
WHEREAS, on the 7th day of July, 1970, a lease of certain real property owned by the
City of Alameda was entered into by and between the City of Alameda, as Lessor, and Santa Fe-
Pomeroy, Inc., a Washington corporation, as Lessee; and
WHEREAS, said Lease requires that the written consent of the Lessor be first had and
obtained prior to the assignment of said Lease to a third party; and
WHEREAS, Santa Fe-Pomeroy, Inc. has requested that the Council of the City of Alameda
consent to the assignment of said Lease to John Bentzen, and John Bentzen has indicated his
desire to accept such assignment; and
WHEREAS, a form of Assignment of Lease between Santa Fe-Pomeroy, Inc. and John Bentzen
has been prepared and submitted to this Council and is on file in the office of the City Clerk
marked, "Filed, December 17, 1974," and the Council is aware of and approves the contents
thereof; and
WHEREAS, It is in the best interests of the City of Alameda that such consent be given;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that said City does
hereby consent to and approve the assignment of that certain Lease dated July 7, 1970 by and
between the City cf Alameda, Lessor, and Santa Fe-Pomeroy, Inc., Lessee, said assignment being
from Santa Fe-Pomeroy, Inc. to John Bentzen.
BE IT FURTHER RESOLVED that the Mayor of the City of Alameda be, and he is hereby,
authorized to execute, for and on behalf of the City, the written consent to execute, for and on
behalf of the City, the written consent of the City to the assignment of said Lease as net out
above. The City Clerk is hereby directed to attest to same.
