Resolution 0847855 CITY OF ALAMEDA RESOLUTION NO. 8478 FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR THE CONSTRUCTION OF A PUBLIC IMPROVEMENT, NAMELY, CONSTRUCTION OF A APRKING LOT FOR PUBLIC AHD EMPLOYEE PARKING NEAR CITY HALL AND THE PROPOSED POLICE HEADQUARTERS IN THE CITY OF ALAMEDA, COUNTY OF ALAMEDA, STATE OF CALIFORNIA, INC FINDING AND DETERMINING THAT THE TAKING IN FEE SIMPLE IS NECESSARY (2216 LINCOLN AVENUE) BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that: 1. The public interest and necessity require the acquisition by the City of Alameda of the property hereinafter described for the construction of a public and City employee parking lot to serve City Hall and the proposed police headquarters in the City of Alameda, County of Alameda, State of California. 2, The taking of said property is authorized by Government Code Sections 40404 and 54031. 3. The property hereinafter specifically described is located generally at 2216 Lincoln Avenue in the City of Alameda. 4. The public interest and necessity require the proposed project and said project is a public use authorized by law. 5. The real property hereinafter described is selected and located in the manner which will be the most compatible with the greatest public good and the least private injury, and said real property is in the opinion of this Council, that which is best adapted for the public use and purposes hereinabove set out. 6. The City Council of the City of Alameda further finds and determines that the taking of the property hereinafter described and the whole thereof in fee simple is necessary. 7. Said real property hereinafter described should be acquired by proceedings in eminent domain in accordance with the appropriate provisions of Part 3, Title 7, of the Code of Civil Procedure of the State of California relating thereto. 8. The City Attorney is hereby authorized and directed to take any and all actions necessary on behalf of the City of Alameda to acquire said property by eminent domain proceedings or otherwise. 9. The property hereinabove referred to is all that real property situated in the City of Alameda, County of Alameda, State of California, more particularly described as follows: Lots 14, 15 and the western one foot of Lct 13, Block 34 of the Lands Adjacent to the Town of Encinal according to the map thereof filed May 28, 1867 Book 19 of Maps, page 53, Alameda County Records. Excepting therefrom, however, that portion thereof included in Lincoln Avenue, as said avenue now exists. * * * * * * * * * * I, the undersigned hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 3rd day of February, 1976, by the following vote, to wit: AYES: Councilmen Beckam, Diament, Hurwitz, Sherratt and President Corica, (5).
