OPPOSING AIRPORT LAND USE COMMISSION LEGISLATIVE PROJECT
COMMITTEE FINAL DRAFT
WHEREAS, state law requires the City to formulate general plans for land use based on
studies of conditions, both existing and that can reasonably he expected, in the City; and
WHEREAS, state law requires that developments can be consistent with the general
plan; and
WHEREAS, the Environmental Quality Act requires the City to examine environmental reports
before approving a project; and
WHEREAS the City will soon have prepared general plans based on detailed studies of
conditions in Alameda; and
WHEREAS legislation is proposed which would give Airport Land Use Commission the power
to disapprove general plans and which makes Airport Land Use Commission plans binding without
benefit of the greater than majority override provision existing in the present law; and
WHEREAS this additional layer of government is set up with an airport bias, is
unnecessary in the face of existing state laws and destroys local and and use control.
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF ALAMEDA does oppose the legislation now
proposed, attached hereto as Exhibit A, for the reasons stated by the City Attorney in the letter
attached hereto as Exhibit B.
BE IT FURTHER RESOLVED THAT this resolution be sent to all Fast Bay legislators and
Cities affected by Airport Land Use Commissions.
