Resolution 0849976 CITY OF ALAMEDA RESOLUTION NO, 8499 PROPOSING AN INITIATIVE ON PETITION SIGNED BY FIFTEEN PERCENT (154) OF THE REGISTERED ELECTORS: CALLING A SPECIAL MUNICIPAL INITIATIVE ELECTION IN CITY OF ALAMEDA FOR THE PURPOSE OF SUBMITTING TO ELECTORS OF SAID CITY THE FOLLOWING RESOLUTION: SHALL ALAMEDA CITY SCHOOL DISTRICT AMEND THE PLANS WITH THE STATE OF CALIFORNIA AND BRING ALAMEDA HIGH SCHOOL INTO CONFORMANCE WITH THE FIELD ACT REQUIREMENTS BY REHABILITATING THE EXISTING STRUCTURES PURSUANT TO ARTICLE III, SECTIONS 3,2 AND 3,3, ARTICLE XI SECTIONS 11.1 AND 11,2 PARAGRAPH 4, AND ARTICLE XXI SECTION 21.1 OF THE CHARTER OF THE CITY OF ALAMEDA, CALIFORNIA: PROVIDING FOR NOTICE AND ADVERTISING CF SAME AND CONSOLIDATING SAID SPECIAL MUNICIPAL INITIATIVE ELECTION WITH STATE PRIMARY ELECTION TO BE HELD ON JUNE 8, 1976 BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA as follows: SECTION 1, The Council of the City of Alameda hereby proposes, on petition signed by fifteen percent (151) of the registered electors, an initiative resolution, to read as provided in the notice entitled "Proposed Initiative Resolution', hereinafter set forth in Section 3 of this resolution. SECTION 2. The Council of the City of Alameda hereby proposes to and does hereby, on petition signed by fifteen percent (154) of the registered electors, submit to the qualified electors of the City of Alameda, as the Special Municipal Initiative Election hereinafter provided for, an initiative resolution set forth in said notice hereinafter set forth in Section 3 of this resolution and designates and refers to said initiative resolution as the initiative resolution to be set forth in the form of ballot hereinafter prescribed for use at said Special Municipal Initiative Election. SECTION 3, The City Clerk of the City of Alameda is hereby ordered and directed to cause said initiative resolution to be published once, not less than forty (40 and not more than sixty (60) days prior to the date of the Special Municipal Initiative Election hereinafter provided for in the ALAMEDA TIMES-STAR, the official newspaper of said City, and in each edition thereof during the day of publication, said newspaper being a newspaper of general circulation published at least six days a week in said City of Alameda; and said publication may be in substantially the following form: INITIATIVE RESOLUTION Special Municipal Initiative Election June 8, 1976 (Consolidated with Primary Election of the State of California) The Council of the City of Alameda hereby proposes, on Petition signed by fifteen percent (15%) of the registered electors, an initiative resolution, The Council of the City of Alameda hereby proposes to and does hereby on petition signed by fifteen percent (154) of the registered electors, submit to the qualified electors of said City at a Special Municipal Initiative Election to be hedl in said City on Tuesday, June 8, 1976 (which said election will be consolidated with the Primary Election of the State of California to be held on June 8, 1976), the following resolution: INITIATIVE RESOLUTION Shall Alameda City School District amend the plans with the State of California and bring Alameda High School into conformance with the Field Act requirements by rehabilitating the existing structures pursuant to Article III, Sections 3,2 and 3.3, Article XI, Sections 11.1 and 11.2 para- graph 4, and Article XXI Section 21.1 of the Charter of the City of Alameda, California, YES NO I hereby certify that the foregoing Initiative Resolution was ordered submitted to the qualified electors of the City of Alameda by the Council of the City of Alameda, Dated: March 1E, 1976 ETHEL M, PITT City Clerk of tlie City of Alameda SECTION 4, (a) A Special Municipal Election is hereby called to be held in the City of Alameda on Tuesday, June 8, 1976 for the purpose cf submitting to the qualified electors of said City said initiative resolution set forth in Section 3 of this resolution and as hereby submitted by the Council of the City of Alameda on petition signed by fifteen percent (154) of the registered electors of said City. (b) Said Special Municipal Initiative Election hereby called shall be held and conducted, and the votes thereat canvassed and the returns thereof made, and the resultt thereof made, and the resolts thereof ascertained and determined as herein provided, and in all particulars not prescribed in this resolution, said Special Municipal Initiative Election shall be held as provided for in the Charter of said City and in all particulars not provided for therein said election shall be held as provided by law for the holding of special municipal elections in the City of Alameda, and otherwise in accordance with the Elections Code of the State of California. (c) All persons qualified to vote at municipal elections in said City of Alameda on the day of the election herein provided for shall he qualified to vote upon said initiative resolution hereby proposed by the Council of the City of Alameda, on petition signed by fifteen percent (1St) of the registered electors of said City, and submitted at said Special Municipal Initiative Election. (d) The polls at the polling places hereinafter designated for said Special Municipal Initiative Election shall be opened at 7:00 a.m, on said day of election, and shall be kept open continuously thereafter until 7:00 p.m, of said day of election when the polls shall be closed (except as provided in Section 14436 of the Election Code), and the election officer shall thereupon proceed to canvass the ballots cast thereat. (e) Said Special Municipal Initiative Election shall be and is hereby consolidated with the Primary Election of the State of California to be held on said City cf Alameda on the date of said Special Municipal Initiative Election hereby called, and the election precincts, polling places and voting booths shall in every case be the same, and there shall be only one set of election officers in each of said precincts; and the precincts, polling places and officers of election for said Special Municipal Initiative Election shall be the same as those to be selected and designated by the Board of Supervisors of the County of Alameda, State of California, for said Primary Election of the State of California in said City of Alameda by resolution or ordinance of the aforesaid Board of Supervisors relating to the holding and conducting of the Primary Election of the State of California, to which resolution or ordinance reference is hereby made for a designation of the precincts, polling places and election officers for the Special Municipal Initiative Election hereby called, (f) Only one form of ballot shall be used at said Primary Election of the State of California and said Special Municipal Initiative Election hereby consolidated therewith, which, in addition to all other matters required by law tc he printed thereon, shall state the resolution set forth in Section 3 hereof. (g) Each voter may vote an the proposed resolution, Tc vote in favor of the proposal a voter shall stamp a cross (X) in the blank space opposite the word "YES on the ballot to the right of the proposal, and to vote against said proposal, a voter shall stamp a cross (X) in the blank space opposite the word "NO on the ballot to the right of said proposal. If a majority of the qualified voters voting an the proposed resolution vote in favor thereof, such a resolution shall be deemed ratified. (1) The returns of said election shall be canvassed, made out and signed by the election officers so designated by the Board of Supervisors, County of Alameda, State of California, and the results thereof transmitted tc the City Clerk of Alameda, and City Council thereof, who shall declare the result thereof in accordance with the Charter of the City of Alameda and the laws of the State of California. SECTION 5. Said initiative resolution set forth in Section 3 hereof shall be net forth in the election proclamation and notice of Special Municipal Initiative Election consolidated with the Primary Election cf the State of California to be held on Tuesday, June 8, 1976, to be published in the time and form required by Sections 19-9 and 19-14 of Article XIX of the Charter of the City of Alameda. SECTION 6. The City Clerk of the City of Alameda is hereby authorized and directed (1) to cause copies of the text of said proposed initiative resolution to he nrinted in convenient pamphlet form and in type of not less than ten-point and to cause copies thereof to he mailed to each of the qualified electors cf said City, and (2) until the day fixed for said Special Municipal Initiative Election to advertise daily in the ALAMEDA TIMES-STAR, H newspaper of general circulation in said City, a notice that copies of said pamphlet may be had on application therefor. Said notice shall be in substantially the following form: NOTICE OF AVAILABILITY OF INITIATIVE RESOLUTION NOTICE IS HEREBY GIVEN to the qualified electors of the City of Alameda that pamphlet copies of the initiative resolution proposed by the City Council, on petition sired by fifteen percent (155) of the registered electors, submitting to electors of said City the following resolution: Shall Alameda City School District amend the plans with the State of California and bring Alameda High School into conformance with the Field Act requirements by rehabilitating the existing structures pursuant to Article III Sections 3.2 and 3.3, Article XI Sections 11.1 and 11.2 paragraph 4, and Article XXI Sectbn 21.1 of the Charter of the City of Alameda, California, are en file in the office of the City Clerk, City Hall, Alameda, California.
