AUTHORIZING EXECUTION OF CONSENT TO REMOVAL BY OWNERS OF REAL
ESTATE, RELATING TO MUNICIPAL GOLF COURSE RESTAURANT
WHEREAS, the City of Alameda and Frederick W. Leitz, hereinafter Concessionaire,
entered into an agreement on October 23, 1975 wherein City granted to Concessionaire the exclusive
right to operate the Alameda Municipal Golf Course Clubhouse Restaurant and Dining Room situated
on the Municipal Golf Courses; and
WHEREAS, Concessionaire agreed to improve and refurbish the restaurant building and to
provide and equio a concession stand on the South Course; and
WHEREAS, to aid in the financing of said improvements Concessionaire has signed a Security
Agreement and Financing Statement with the Bank of America NT & SA; and
WHEREAS, said Bark, under the terms of their Small Business Administration loan to
Concessionaire, requires the ability to remove the property subject to the Security Agreement and
Financing Statement should a default occur; and
WHEREAS a Consent to Removal by Owner of Real estate has been submitted to the City of
Alameda and the City Council is fully informed and aware of the contents thereof; and
WHEREAS, it is in the best interests of the City of Alameda that said Corsent be signed;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the City
Manager is hereby authorized and directed to execute, for and on behalf of the City of Alameda, that
certain Consent to Removal by Owner of Real Estate referred to above, and the City Clerk is
hereby directed to attest to same.

introduced and adopted by the Council of the City of Alameda in regular meeting assembled or the
4th day of May, 1976, by the following vote, to wit:
AYES: Councilmen Beckam, Diament, Hurwitz, Sherratt and President Corica, (5).
