Resolution 086773(18 CITY OF ALAMEDA RESOLUTION NO, 8677 APPROVING AMENDMENT TO JOINT EXERCISE OF POWERS AGREEMENT FOR SOLID WASTE MANAGEMENT WHEREAS, on May 18, 1976 the Board of Supervisors of Alameda County approved a Solid Waste Management Plan for the County of Alameda. This Plan was subsequently approved by a majority of the cities of Alameda County and has been submitted for approval by the State; and WHEREAS, the Plan provides for administration of the Plan under provisions of a Joint Exercise of Powers Agreement between cities, special districts and the County. Such agreement was approved by all cities, special districts and the County in August and September, 1976, and was forwarded to the State on September 2, 1976 as a part of the Solid Waste Management Plan. The Solid Waste Management Board was established as the governing body under the Joint Exercise of Powers Agreement; and WHEREAS, the Solid Waste Management Plan provides that "a countywide facilities plan will be developed by the Joint Powers Board." The Joint Exercise of Powers Agreement provides that the Solid Waste Management Authority shall have the power to administer and enforce the provisions of the Solid Waste Management Plan, but the Agreement itself contains no specific statement of the power to develop and approve a Facilities Plan. The Attorney General, in reviewing the submission by the County to the State, has advised that inclusion of such specific statement within the Joint Exercise of Powers Agreement, as well as within the Plan, is necessary to provide authority to the Solid Waste Management Board for approval of the Facilities Plan under provisions of the Government Code; and WHEREAS, an amendment to the Joint Exercise of Powers Agreement has been prepared setting forth as a provision of the Agreement the power of the Solid Waste Management Authority to develop, adopt and revise a Facilities Plan in accordance with the Solid Waste Management plan; such amendment is attached hereto and is recommended by the Solid Waste Management Board for approval by parties to the Agreement. NOW, THEREBORF, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that that certain Amendment to Joint Exercise of Powers Agreement for Solid Waste Management attached hereto is hereby approved and the Mayor is hereby authorized and directed to execute the same on behalf of the City of Alameda.
